77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a grant program to provide free or reduced-tuition
1010 prekindergarten classes to certain children.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E, Chapter 29, Education Code, is
1313 amended by adding Section 29.1535 to read as follows:
1414 Sec. 29.1535. FREE AND REDUCED-TUITION PREKINDERGARTEN
1515 GRANT PROGRAM. (a) From money appropriated or otherwise available
1616 for the purpose, the commissioner, in collaboration with the Pre-K
1717 4 SA early childhood initiative, shall establish and administer a
1818 grant program to support school districts, open-enrollment charter
1919 schools, and private schools in providing free or reduced-tuition
2020 prekindergarten classes to eligible children.
2121 (b) A school district, open-enrollment charter school, or
2222 private school shall use money received under the grant program to
2323 provide free or reduced-tuition prekindergarten classes to
2424 eligible children.
2525 (c) A child is eligible to enroll in a prekindergarten class
2626 described by Subsection (b) if the child is at least three years of
2727 age.
2828 (d) To the extent consistent with state and federal law, a
2929 prekindergarten class provided using money received under the grant
3030 program must be operated in accordance with any curriculum and
3131 teaching methods implemented by the Pre-K 4 SA early childhood
3232 initiative.
3333 (e) Not later than September 1 of each year, the
3434 commissioner shall prepare and submit to the legislature a report
3535 on the grant program under this section. The report must include:
3636 (1) an evaluation of the academic and developmental
3737 achievements of students enrolled in a prekindergarten class using
3838 money received under the grant program; and
3939 (2) any recommendations for legislative or other
4040 action.
4141 (f) The commissioner shall adopt rules as necessary to
4242 establish and administer the grant program under this section.
4343 (g) The grant program is abolished and this section expires
4444 January 1, 2031.
4545 SECTION 2. Not later than September 1, 2026, the
4646 commissioner of education shall submit the initial report required
4747 by Section 29.1535, Education Code, as added by this Act.
4848 SECTION 3. This Act applies beginning with the 2025-2026
4949 school year.
5050 SECTION 4. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2025.
