9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Subchapter A, Chapter 61, Election Code, is | |
11 | 11 | amended by adding Section 61.015 to read as follows: | |
12 | 12 | Sec. 61.015. WATER ALLOCATION TO VOTERS NEAR POLLING PLACE. | |
13 | 13 | (a) A person may distribute water to voters waiting in line at a | |
14 | 14 | polling place, if: | |
15 | 15 | (1) the water: | |
16 | 16 | (A) is provided in a single use, sealed | |
17 | 17 | container; and | |
18 | 18 | (B) does not contain any branding, logos, or | |
19 | 19 | messaging related to a campaign, measure, or political party; and | |
20 | 20 | (2) the distribution of the water: | |
21 | 21 | (A) is conducted in a nonpartisan manner; and | |
22 | 22 | (B) does not obstruct or interfere with the | |
23 | 23 | voting process. | |
24 | 24 | (b) A person distributing water under this section may not | |
25 | 25 | wear attire or display materials that represent a campaign, | |
26 | 26 | measure, or political party. | |
27 | 27 | (c) Election officials shall ensure that any person | |
28 | 28 | distributing water at a polling place complies with this section. | |
29 | 29 | The election official may remove a person found in violation of this | |
30 | 30 | section from the polling place. | |
31 | 31 | SECTION 2. This Act takes effect September 1, 2025. |
