77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the release of certain areas from a municipality's
1010 extraterritorial jurisdiction by petition or election.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 42.101, Local Government Code, is
1313 amended to read as follows:
1414 Sec. 42.101. APPLICABILITY. This subchapter does not apply
1515 to an area located:
1616 (1) within:
1717 (A) one-quarter mile of the corporate boundaries
1818 of a municipality with a population of less than 5,000;
1919 (B) one-half mile of the corporate boundaries of
2020 a municipality with a population of 5,000 to 24,999;
2121 (C) one mile of the corporate boundaries of a
2222 municipality with a population of 25,000 to 49,999;
2323 (D) 1-1/2 miles of the corporate boundaries of a
2424 municipality with a population of 50,000 to 99,999; or
2525 (E) 2-1/2 miles of the corporate boundaries of a
2626 municipality with a population of 100,000 or more;
2727 (2) within five miles of the boundary of a military
2828 base, as defined by Section 43.0117, at which an active training
2929 program is conducted;
3030 (3) [(2)] in an area that was voluntarily annexed into
3131 the extraterritorial jurisdiction that is located in a county:
3232 (A) in which the population grew by more than 50
3333 percent from the previous federal decennial census in the federal
3434 decennial census conducted in 2020; and
3535 (B) that has a population greater than 240,000;
3636 (4) [(3)] within the portion of the extraterritorial
3737 jurisdiction of a municipality with a population of more than 1.4
3838 million that is:
3939 (A) within 15 miles of the boundary of a military
4040 base, as defined by Section 43.0117, at which an active training
4141 program is conducted; and
4242 (B) in a county with a population of more than two
4343 million;
4444 (5) [(4)] in an area designated as an industrial
4545 district under Section 42.044; [or]
4646 (6) [(5)] in an area subject to a strategic
4747 partnership agreement entered into under Section 43.0751; or
4848 (7) in an area identified in a municipality's
4949 long-range master plan for land use, water infrastructure,
5050 wastewater infrastructure, or roadways.
5151 SECTION 2. Section 42.151, Local Government Code, is
5252 amended to read as follows:
5353 Sec. 42.151. APPLICABILITY. This subchapter does not apply
5454 to an area located:
5555 (1) within:
5656 (A) one-quarter mile of the corporate boundaries
5757 of a municipality with a population of less than 5,000;
5858 (B) one-half mile of the corporate boundaries of
5959 a municipality with a population of 5,000 to 24,999;
6060 (C) one mile of the corporate boundaries of a
6161 municipality with a population of 25,000 to 49,999;
6262 (D) 1-1/2 miles of the corporate boundaries of a
6363 municipality with a population of 50,000 to 99,999; or
6464 (E) 2-1/2 miles of the corporate boundaries of a
6565 municipality with a population of 100,000 or more;
6666 (2) within five miles of the boundary of a military
6767 base, as defined by Section 43.0117, at which an active training
6868 program is conducted;
6969 (3) [(2)] in an area that was voluntarily annexed into
7070 the extraterritorial jurisdiction that is located in a county:
7171 (A) in which the population grew by more than 50
7272 percent from the previous federal decennial census in the federal
7373 decennial census conducted in 2020; and
7474 (B) that has a population greater than 240,000;
7575 (4) [(3)] within the portion of the extraterritorial
7676 jurisdiction of a municipality with a population of more than 1.4
7777 million that is:
7878 (A) within 15 miles of the boundary of a military
7979 base, as defined by Section 43.0117, at which an active training
8080 program is conducted; and
8181 (B) in a county with a population of more than two
8282 million;
8383 (5) [(4)] in an area designated as an industrial
8484 district under Section 42.044; [or]
8585 (6) [(5)] in an area subject to a strategic
8686 partnership agreement entered into under Section 43.0751; or
8787 (7) in an area identified in a municipality's
8888 long-range master plan for land use, water infrastructure,
8989 wastewater infrastructure, or roadways.
9090 SECTION 3. The changes in law made by this Act apply only to
9191 the eligibility of an area to be released from a municipality's
9292 extraterritorial jurisdiction as the result of a petition filed
9393 under Subchapter D, Chapter 42, Local Government Code, or an
9494 election requested under Subchapter E of that chapter, as
9595 applicable, on or after the effective date of this Act.
9696 SECTION 4. This Act takes effect September 1, 2025.
