77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the expansion of eligibility for Medicaid to certain
1010 individuals diagnosed with certain mental health disorders.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 32, Human Resources Code,
1313 is amended by adding Section 32.02473 to read as follows:
1414 Sec. 32.02473. EXPANDED ELIGIBILITY FOR MEDICAL
1515 ASSISTANCE. (a) Notwithstanding any other law, the commission
1616 shall provide medical assistance to all individuals:
1717 (1) who are diagnosed with bipolar disorder,
1818 dysthymia, schizophrenia, or severe chronic depression;
1919 (2) who have a family income that does not exceed 133
2020 percent of the applicable federal poverty level;
2121 (3) who apply for the assistance; and
2222 (4) for whom federal matching money is available.
2323 (b) The executive commissioner shall adopt rules necessary
2424 to implement this section.
2525 SECTION 2. Section 32.02473, Human Resources Code, as added
2626 by this Act, applies only to an initial determination or
2727 recertification of eligibility of an individual for medical
2828 assistance under Chapter 32, Human Resources Code, made on or after
2929 the date the section is implemented, regardless of the date the
3030 individual applied for that assistance.
3131 SECTION 3. As soon as possible after the effective date of
3232 this Act, the executive commissioner of the Health and Human
3333 Services Commission shall take all necessary actions to expand
3434 eligibility for medical assistance under Chapter 32, Human
3535 Resources Code, in accordance with Section 32.02473, Human
3636 Resources Code, as added by this Act, including notifying
3737 appropriate federal agencies of that expanded eligibility.
3838 SECTION 4. If before implementing any provision of this Act
3939 a state agency determines that any other waiver or authorization
4040 from a federal agency is necessary for implementation of that
4141 provision, the agency affected by the provision shall request the
4242 waiver or authorization and may delay implementing that provision
4343 until the waiver or authorization is granted.
4444 SECTION 5. This Act takes effect September 1, 2025.
