77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the operation of certain off-highway vehicles on
1010 certain roadways.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 551A, Transportation Code,
1313 is amended by adding Section 551A.060 to read as follows:
1414 Sec. 551A.060. OPERATION OF CERTAIN OFF-HIGHWAY VEHICLES ON
1515 CERTAIN HIGHWAYS. (a) This section applies only to an off-highway
1616 vehicle that is:
1717 (1) a recreational off-highway vehicle equipped with
1818 side-by-side seating for the use of the operator and a passenger; or
1919 (2) a utility vehicle.
2020 (b) Notwithstanding any other provision of this subchapter,
2121 an operator may operate an unregistered off-highway vehicle
2222 described by Subsection (a) on a highway for which the posted speed
2323 limit is not more than 65 miles per hour if:
2424 (1) the highway is not an interstate or limited access
2525 highway; and
2626 (2) the vehicle displays a license plate issued under
2727 Section 551A.052.
2828 SECTION 2. This Act takes effect immediately if it receives
2929 a vote of two-thirds of all the members elected to each house, as
3030 provided by Section 39, Article III, Texas Constitution. If this
3131 Act does not receive the vote necessary for immediate effect, this
3232 Act takes effect September 1, 2025.
