| 11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 12 | 12 | SECTION 1. Subchapter D, Chapter 551A, Transportation Code, | |
| 13 | 13 | is amended by adding Section 551A.060 to read as follows: | |
| 14 | 14 | Sec. 551A.060. OPERATION OF CERTAIN OFF-HIGHWAY VEHICLES ON | |
| 15 | 15 | CERTAIN HIGHWAYS. (a) This section applies only to an off-highway | |
| 16 | 16 | vehicle that is: | |
| 17 | 17 | (1) a recreational off-highway vehicle equipped with | |
| 18 | 18 | side-by-side seating for the use of the operator and a passenger; or | |
| 19 | 19 | (2) a utility vehicle. | |
| 20 | 20 | (b) Notwithstanding any other provision of this subchapter, | |
| 21 | 21 | an operator may operate an unregistered off-highway vehicle | |
| 22 | 22 | described by Subsection (a) on a highway for which the posted speed | |
| 23 | 23 | limit is not more than 65 miles per hour if: | |
| 24 | 24 | (1) the highway is not an interstate or limited access | |
| 25 | 25 | highway; and | |
| 26 | 26 | (2) the vehicle displays a license plate issued under | |
| 27 | 27 | Section 551A.052. | |
| 28 | 28 | SECTION 2. This Act takes effect immediately if it receives | |
| 29 | 29 | a vote of two-thirds of all the members elected to each house, as | |
| 30 | 30 | provided by Section 39, Article III, Texas Constitution. If this | |
| 31 | 31 | Act does not receive the vote necessary for immediate effect, this | |
| 32 | 32 | Act takes effect September 1, 2025. |
