77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to employment restrictions for certain former county or
1010 municipal officers and employees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 171, Local Government Code, is amended
1313 by adding Section 171.008 to read as follows:
1414 Sec. 171.008. EMPLOYMENT FOR CERTAIN FORMER COUNTY OR
1515 MUNICIPAL OFFICERS AND EMPLOYEES RESTRICTED. (a) Except as
1616 provided by Subsection (b), a former county or municipal officer or
1717 employee who during the period of county or municipal service or
1818 employment participated on behalf of the county or municipality in
1919 a contract negotiation or procurement involving a person may not
2020 accept employment from that person before the second anniversary of
2121 the date the contract is signed or the procurement is terminated or
2222 withdrawn.
2323 (b) The governing body of a county or municipality may, on
2424 an individual basis, waive the applicability of the prohibition
2525 under Subsection (a) for a former county or municipal officer or
2626 employee who submits to the governing body an application for a
2727 waiver from the prohibition in the form and manner the governing
2828 body requires.
2929 SECTION 2. Section 171.008, Local Government Code, as added
3030 by this Act, applies only to a county or municipal officer or
3131 employee whose service or employment with a county or municipality
3232 ceases on or after the effective date of this Act.
3333 SECTION 3. This Act takes effect September 1, 2025.
