11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 171, Local Government Code, is amended |
---|
13 | 13 | | by adding Section 171.008 to read as follows: |

14 | 14 | | Sec. 171.008. EMPLOYMENT FOR CERTAIN FORMER COUNTY OR |
---|
15 | 15 | | MUNICIPAL OFFICERS AND EMPLOYEES RESTRICTED. (a) Except as |
---|
16 | 16 | | provided by Subsection (b), a former county or municipal officer or |
---|
17 | 17 | | employee who during the period of county or municipal service or |
---|
18 | 18 | | employment participated on behalf of the county or municipality in |
---|
19 | 19 | | a contract negotiation or procurement involving a person may not |
---|
20 | 20 | | accept employment from that person before the second anniversary of |
---|
21 | 21 | | the date the contract is signed or the procurement is terminated or |
---|
22 | 22 | | withdrawn. |
---|
23 | 23 | | (b) The governing body of a county or municipality may, on |
---|
24 | 24 | | an individual basis, waive the applicability of the prohibition |
---|
25 | 25 | | under Subsection (a) for a former county or municipal officer or |
---|
26 | 26 | | employee who submits to the governing body an application for a |
---|
27 | 27 | | waiver from the prohibition in the form and manner the governing |
---|
28 | 28 | | body requires. |

29 | 29 | | SECTION 2. Section 171.008, Local Government Code, as added |
---|
30 | 30 | | by this Act, applies only to a county or municipal officer or |
---|
31 | 31 | | employee whose service or employment with a county or municipality |
---|
32 | 32 | | ceases on or after the effective date of this Act. |
---|
33 | 33 | | SECTION 3. This Act takes effect September 1, 2025. |
