7	7	A BILL TO BE ENTITLED
8	8	AN ACT
9	9	relating to the administration of an election for a member of a
10	10	board of trustees of an independent school district.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Section 11.052(h), Education Code, is amended to
13	13	read as follows:
14	14	(h) At the first election at which some or all of the
15	15	trustees are elected in a manner authorized by this section and
16	16	after each redistricting, all positions on the board shall be
17	17	filled. [The trustees then elected shall draw lots for staggered
18	18	terms as provided by Section 11.059.]
19	19	SECTION 2. Section 11.053(b), Education Code, is amended to
20	20	read as follows:
21	21	(b) The trustee district and any at-large positions
22	22	provided by the district's plan shall be filled when [as] the
23	23	[staggered] terms of trustees then in office expire. [Not later
24	24	than the 90th day before the date of the first election from trustee
25	25	districts and after each redistricting, the board shall determine
26	26	the order in which the positions will be filled.]
27	27	SECTION 3. Section 11.058(e), Education Code, is amended to
28	28	read as follows:
29	29	(e) The board shall also, not later than the 60th day before
30	30	the date of the election, number the positions on the board [in the
31	31	order in which the terms of office of the trustees expire].
32	32	SECTION 4. Section 11.0581(a), Education Code, is amended
33	33	to read as follows:
34	34	(a) An election for trustees of an independent school
35	35	district shall be held on the same date as[:
36	36	[(1) the election for the members of the governing
37	37	body of a municipality located in the school district;
38	38	[(2)] the general election for state and county
39	39	officers [;
40	40	[(3) the election for the members of the governing
41	41	body of a hospital district, if the school district:
42	42	[(A) is wholly or partly located in a county with
43	43	a population of less than 50,000 that is adjacent to a county with a
44	44	population of more than three million; and
45	45	[(B) held its election for trustees jointly with
46	46	the election for the members of the governing body of the hospital
47	47	district before May 2007; or
48	48	[(4) the election for the members of the governing
49	49	board of a public junior college district in which the school
50	50	district is wholly or partly located].
51	51	SECTION 5. Section 11.059(a), Education Code, is amended to
52	52	read as follows:
53	53	(a) A trustee of an independent school district serves a
54	54	term of two [three or four] years.
55	55	SECTION 6. Section 11.065(a), Education Code, is amended to
56	56	read as follows:
57	57	(a) Sections 11.052(g) and (h) and Section 11.059 [Sections
58	58	11.059(a) and (b)] do not apply to the board of trustees of a school
59	59	district if:
60	60	(1) the district's central administrative office is
61	61	located in a county with a population of more than 2.5 million; and
62	62	(2) the district's student enrollment is more than
63	63	125,000 and less than 200,000.
64	64	SECTION 7. Section 11.303, Education Code, is amended by
65	65	adding Subsection (a-1) to read as follows:
66	66	(a-1) A municipal school district shall hold any election
67	67	for the board of trustees of the district under Subchapter C. A
68	68	member of the board of trustees of a municipal school district
69	69	serves a term of two years.
70	70	SECTION 8. Sections 49.353(b) and (c), Education Code, are
71	71	amended to read as follows:
72	72	(b) The transitional board of trustees shall divide the
73	73	consolidated district into nine single-member trustee districts in
74	74	accordance with the procedures provided by Section 11.052. The
75	75	transitional board shall order an election for the initial board of
76	76	trustees to be held on the first [May] uniform election date in
77	77	November of an even-numbered year after the effective date of a
78	78	consolidation order.
79	79	(c) Members of the board of trustees of a consolidated
80	80	district serve [staggered] terms of two [office for four] years.
81	81	SECTION 9. Section 41.0052(a-1), Election Code, as added by
82	82	Chapter 985 (S.B. 2620), Acts of the 88th Legislature, Regular
83	83	Session, 2023, is amended to read as follows:
84	84	(a-1) Notwithstanding Subsection (a), a municipality [,
85	85	independent school district,] or hospital district wholly or partly
86	86	located in a county with a population of more than 19,900 and less
87	87	than 20,000 that holds its general election for officers on a date
88	88	other than the November uniform election date may change the date on
89	89	which it holds its general election for officers to the November
90	90	uniform election date.
91	91	SECTION 10. Section 41.0052, Election Code, is amended by
92	92	adding Subsection (a-2) to read as follows:
93	93	(a-2) The governing body of an independent school district
94	94	that holds its general election for officers on a date other than
95	95	the date of the general election for state and county officers
96	96	shall, not later than December 31, 2025, change the date on which
97	97	the governing body holds its general election for officers to that
98	98	date. This subsection expires January 1, 2029.
99	99	SECTION 11. The following provisions are repealed:
100	100	(1) Sections 11.059(b), (c), (d), (e), (f), and (g),
101	101	Education Code; and
102	102	(2) Section 41.0052(a-1), Election Code, as added by
103	103	Chapter 1160 (S.B. 1131), Acts of the 88th Legislature, Regular
104	104	Session, 2023.
105	105	SECTION 12. Notwithstanding Section 11.0581(d), Education
106	106	Code, the board of trustees of an independent school district or of
107	107	a municipal school district that adjusts the terms of office of its
108	108	members to comply with the changes in law made by this Act may not:
109	109	(1) permit a member of the board of trustees to serve a
110	110	term of office longer than two years more than the term to which the
111	111	member was originally elected; or
112	112	(2) shorten the term of office of any member of the
113	113	board of trustees.
114	114	SECTION 13. To the extent of any conflict, this Act prevails
115	115	over another Act of the 89th Legislature, Regular Session, 2025,
116	116	relating to nonsubstantive additions to and corrections in enacted
117	117	codes.
118	118	SECTION 14. This Act takes effect September 1, 2025.
