77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the administration of an election for a member of a
1010 board of trustees of an independent school district.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 11.052(h), Education Code, is amended to
1313 read as follows:
1414 (h) At the first election at which some or all of the
1515 trustees are elected in a manner authorized by this section and
1616 after each redistricting, all positions on the board shall be
1717 filled. [The trustees then elected shall draw lots for staggered
1818 terms as provided by Section 11.059.]
1919 SECTION 2. Section 11.053(b), Education Code, is amended to
2020 read as follows:
2121 (b) The trustee district and any at-large positions
2222 provided by the district's plan shall be filled when [as] the
2323 [staggered] terms of trustees then in office expire. [Not later
2424 than the 90th day before the date of the first election from trustee
2525 districts and after each redistricting, the board shall determine
2626 the order in which the positions will be filled.]
2727 SECTION 3. Section 11.058(e), Education Code, is amended to
2828 read as follows:
2929 (e) The board shall also, not later than the 60th day before
3030 the date of the election, number the positions on the board [in the
3131 order in which the terms of office of the trustees expire].
3232 SECTION 4. Section 11.0581(a), Education Code, is amended
3333 to read as follows:
3434 (a) An election for trustees of an independent school
3535 district shall be held on the same date as[:
3636 [(1) the election for the members of the governing
3737 body of a municipality located in the school district;
3838 [(2)] the general election for state and county
3939 officers [;
4040 [(3) the election for the members of the governing
4141 body of a hospital district, if the school district:
4242 [(A) is wholly or partly located in a county with
4343 a population of less than 50,000 that is adjacent to a county with a
4444 population of more than three million; and
4545 [(B) held its election for trustees jointly with
4646 the election for the members of the governing body of the hospital
4747 district before May 2007; or
4848 [(4) the election for the members of the governing
4949 board of a public junior college district in which the school
5050 district is wholly or partly located].
5151 SECTION 5. Section 11.059(a), Education Code, is amended to
5252 read as follows:
5353 (a) A trustee of an independent school district serves a
5454 term of two [three or four] years.
5555 SECTION 6. Section 11.065(a), Education Code, is amended to
5656 read as follows:
5757 (a) Sections 11.052(g) and (h) and Section 11.059 [Sections
5858 11.059(a) and (b)] do not apply to the board of trustees of a school
5959 district if:
6060 (1) the district's central administrative office is
6161 located in a county with a population of more than 2.5 million; and
6262 (2) the district's student enrollment is more than
6363 125,000 and less than 200,000.
6464 SECTION 7. Section 11.303, Education Code, is amended by
6565 adding Subsection (a-1) to read as follows:
6666 (a-1) A municipal school district shall hold any election
6767 for the board of trustees of the district under Subchapter C. A
6868 member of the board of trustees of a municipal school district
6969 serves a term of two years.
7070 SECTION 8. Sections 49.353(b) and (c), Education Code, are
7171 amended to read as follows:
7272 (b) The transitional board of trustees shall divide the
7373 consolidated district into nine single-member trustee districts in
7474 accordance with the procedures provided by Section 11.052. The
7575 transitional board shall order an election for the initial board of
7676 trustees to be held on the first [May] uniform election date in
7777 November of an even-numbered year after the effective date of a
7878 consolidation order.
7979 (c) Members of the board of trustees of a consolidated
8080 district serve [staggered] terms of two [office for four] years.
8181 SECTION 9. Section 41.0052(a-1), Election Code, as added by
8282 Chapter 985 (S.B. 2620), Acts of the 88th Legislature, Regular
8383 Session, 2023, is amended to read as follows:
8484 (a-1) Notwithstanding Subsection (a), a municipality [,
8585 independent school district,] or hospital district wholly or partly
8686 located in a county with a population of more than 19,900 and less
8787 than 20,000 that holds its general election for officers on a date
8888 other than the November uniform election date may change the date on
8989 which it holds its general election for officers to the November
9090 uniform election date.
9191 SECTION 10. Section 41.0052, Election Code, is amended by
9292 adding Subsection (a-2) to read as follows:
9393 (a-2) The governing body of an independent school district
9494 that holds its general election for officers on a date other than
9595 the date of the general election for state and county officers
9696 shall, not later than December 31, 2025, change the date on which
9797 the governing body holds its general election for officers to that
9898 date. This subsection expires January 1, 2029.
9999 SECTION 11. The following provisions are repealed:
100100 (1) Sections 11.059(b), (c), (d), (e), (f), and (g),
101101 Education Code; and
102102 (2) Section 41.0052(a-1), Election Code, as added by
103103 Chapter 1160 (S.B. 1131), Acts of the 88th Legislature, Regular
104104 Session, 2023.
105105 SECTION 12. Notwithstanding Section 11.0581(d), Education
106106 Code, the board of trustees of an independent school district or of
107107 a municipal school district that adjusts the terms of office of its
108108 members to comply with the changes in law made by this Act may not:
109109 (1) permit a member of the board of trustees to serve a
110110 term of office longer than two years more than the term to which the
111111 member was originally elected; or
112112 (2) shorten the term of office of any member of the
113113 board of trustees.
114114 SECTION 13. To the extent of any conflict, this Act prevails
115115 over another Act of the 89th Legislature, Regular Session, 2025,
116116 relating to nonsubstantive additions to and corrections in enacted
117117 codes.
118118 SECTION 14. This Act takes effect September 1, 2025.
