77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to tuition and fee exemptions at public institutions of
1010 higher education for certain child-care workers.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter D, Chapter 54, Education Code, is
1313 amended by adding Section 54.3532 to read as follows:
1414 Sec. 54.3532. CHILD-CARE EMPLOYEES ENROLLED IN CERTAIN
1515 COURSES. (a) The governing board of an institution of higher
1616 education shall exempt from the payment of tuition and required
1717 fees charged by the institution for a child development or early
1818 childhood education course or courses an undergraduate student who:
1919 (1) is employed at a child-care facility licensed
2020 under Subchapter C, Chapter 42, Human Resources Code;
2121 (2) is enrolled in an associate degree or certificate
2222 program in child development or early childhood education at the
2323 institution;
2424 (3) is making satisfactory academic progress toward
2525 the student's degree or certificate program as determined by the
2626 institution; and
2727 (4) applies for the exemption not later than the
2828 seventh day before the last date of the institution's regular
2929 registration period for the applicable semester or other term.
3030 (b) Notwithstanding Subsection (a), a student may not
3131 receive an exemption under that subsection for any course if the
3232 student has previously attempted a number of semester credit hours
3333 for courses taken at any institution of higher education while
3434 classified as a resident student for tuition purposes in excess of
3535 the maximum number of those hours specified by Section 61.0595(a)
3636 as eligible for funding under the formulas established under
3737 Section 61.059.
3838 (c) Notwithstanding Subsection (a), the governing board of
3939 an institution of higher education may not provide exemptions under
4040 that subsection to students enrolled in a specific class in a number
4141 that exceeds 20 percent of the maximum student enrollment
4242 designated by the institution for that class.
4343 (d) An exemption provided under this section does not apply
4444 to deposits that may be required in the nature of security for the
4545 return or proper care of property loaned for the use of students.
4646 (e) The coordinating board shall adopt:
4747 (1) rules governing the granting or denial of an
4848 exemption under this section, including rules relating to the
4949 determination of a student's eligibility for an exemption; and
5050 (2) a uniform listing of degree programs covered by
5151 the exemption under this section.
5252 (f) If the legislature does not specifically appropriate
5353 funds to an institution of higher education in an amount sufficient
5454 to pay the institution's costs in complying with this section for a
5555 semester, the governing board of the institution of higher
5656 education shall report to the Senate Finance Committee and the
5757 House Appropriations Committee the cost to the institution of
5858 complying with this section for that semester.
5959 SECTION 2. (a) The Texas Higher Education Coordinating
6060 Board shall adopt the rules required by Section 54.3532, Education
6161 Code, as added by this Act, as soon as practicable after the
6262 effective date of this Act.
6363 (b) Section 54.3532, Education Code, as added by this Act,
6464 applies beginning with tuition and required fees charged for the
6565 2025 fall semester. Tuition and required fees charged for an
6666 academic period before that semester are governed by the law in
6767 effect immediately before the effective date of this Act, and the
6868 former law is continued in effect for that purpose.
6969 SECTION 3. This Act takes effect immediately if it receives
7070 a vote of two-thirds of all the members elected to each house, as
7171 provided by Section 39, Article III, Texas Constitution. If this
7272 Act does not receive the vote necessary for immediate effect, this
7373 Act takes effect September 1, 2025.
