77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to peer support specialists for certain individuals with
1010 an intellectual or developmental disability and peer services for
1111 those individuals under Medicaid.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 547, Government Code, as
1414 effective April 1, 2025, is amended by adding Section 547.00031 to
1515 read as follows:
1616 Sec. 547.00031. PEER SUPPORT SPECIALISTS FOR CERTAIN
1717 INDIVIDUALS WITH AN INTELLECTUAL OR DEVELOPMENTAL DISABILITY. (a)
1818 With input from intellectual and developmental disability peer
1919 support specialists and the stakeholder work group described by
2020 Subsection (c), the commission shall develop and the executive
2121 commissioner shall adopt:
2222 (1) rules to establish accessible and validated
2323 training requirements for peer support specialists who provide
2424 services to individuals with an intellectual or developmental
2525 disability;
2626 (2) rules that establish certification and
2727 supervision requirements for intellectual and developmental
2828 disability peer support specialists to ensure compliance with this
2929 section;
3030 (3) rules that define the scope of services an
3131 intellectual and developmental disability peer support specialist
3232 may provide;
3333 (4) rules that distinguish peer support services for
3434 individuals with an intellectual or developmental disability from
3535 other services that require the provider to hold a license or
3636 certification; and
3737 (5) any other rules necessary to protect the health
3838 and safety of individuals receiving peer support services.
3939 (b) The rules adopted under Subsection (a) do not apply to
4040 the provision of peer support services to residents of a state
4141 supported living center, as defined by Section 531.002, Health and
4242 Safety Code.
4343 (c) The commission shall establish a stakeholder work group
4444 to provide input for the adoption of rules under Subsection (a).
4545 The work group is composed of the following stakeholders appointed
4646 by the executive commissioner:
4747 (1) at least one mental health and substance use
4848 disorder peer support specialist;
4949 (2) at least one intellectual and developmental
5050 disability peer support specialist;
5151 (3) a representative of each of the following:
5252 (A) the commission's Peer and Recovery Services
5353 Programs, Planning, and Policy unit;
5454 (B) the commission's Office of Disability
5555 Services Coordination;
5656 (C) the Texas Council for Developmental
5757 Disabilities;
5858 (D) Texas Parent to Parent; and
5959 (E) Texas Advocates; and
6060 (4) a person who is certified as a trainer by the
6161 Learning Community for Person Centered Practices under the People
6262 Planning Together program.
6363 (d) The executive commissioner shall appoint one member of
6464 the work group to serve as presiding officer.
6565 (e) The work group shall meet once every month.
6666 (f) The work group is automatically abolished on the
6767 adoption of rules under Subsection (a).
6868 SECTION 2. Section 32.024(kk), Human Resources Code, is
6969 amended to read as follows:
7070 (kk) The commission in its rules and standards governing the
7171 scope of services provided under the medical assistance program
7272 shall include peer services provided by certified peer specialists,
7373 including peer support services provided to individuals with an
7474 intellectual or developmental disability, to the extent permitted
7575 by federal law.
7676 SECTION 3. As soon as practicable after the effective date
7777 of this Act, the executive commissioner of the Health and Human
7878 Services Commission shall appoint the members of the stakeholder
7979 work group established by Section 547.00031(c), Government Code, as
8080 added by this Act.
8181 SECTION 4. If before implementing any provision of this Act
8282 a state agency determines that a waiver or authorization from a
8383 federal agency is necessary for implementation of that provision,
8484 the agency affected by the provision shall request the waiver or
8585 authorization and may delay implementing that provision until the
8686 waiver or authorization is granted.
8787 SECTION 5. This Act takes effect September 1, 2025.
