6	8		AN ACT
7	9		relating to the participation of an advanced practice registered
8	10		nurse as a participating or preferred provider for health
9	11		maintenance organizations and preferred provider benefit plans.
10	12		BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	13		SECTION 1. Subchapter I, Chapter 843, Insurance Code, is
12	14		amended by adding Section 843.3125 to read as follows:
13	15		Sec. 843.3125. CONTRACTS WITH ADVANCED PRACTICE REGISTERED
14	16		NURSES. (a) A health maintenance organization may contract
15	17		directly with an advanced practice registered nurse to provide
16	18		health care services on behalf of the health maintenance
17	19		organization regardless of whether the physician supervising the
18	20		advanced practice registered nurse provides health care services
19	21		for the health maintenance organization.
20	22		(b) This section may not be construed as authorizing a
21	23		health maintenance organization to supervise or control the
22	24		practice of medicine as prohibited by Subtitle B, Title 3,
23	25		Occupations Code.
24	26		SECTION 2. Subchapter B, Chapter 1301, Insurance Code, is
25	27		amended by adding Section 1301.0525 to read as follows:
26	28		Sec. 1301.0525. DESIGNATION OF ADVANCED PRACTICE
27	29		REGISTERED NURSES AS PREFERRED PROVIDERS. (a) An insurer offering
28	30		a preferred provider benefit plan may designate an advanced
29	31		practice registered nurse as a preferred provider regardless of
30	32		whether the physician supervising the advanced practice registered
31	33		nurse is a preferred provider.
32	34		(b) This section may not be construed as authorizing an
33	35		insurer to supervise or control the practice of medicine as
34	36		prohibited by Subtitle B, Title 3, Occupations Code.
35	37		SECTION 3. This Act takes effect September 1, 2025.
