77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the confidentiality of a public or private school
1010 employee's home address information in property tax appraisal
1111 records.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 25.025(a), Tax Code, as amended by
1414 Chapters 76 (S.B. 617), 152 (S.B. 870), 430 (H.B. 1911), 765 (H.B.
1515 4504), and 937 (S.B. 1525), Acts of the 88th Legislature, Regular
1616 Session, 2023, is reenacted and amended to read as follows:
1717 (a) This section applies only to:
1818 (1) a current or former peace officer as defined by
1919 Article 2A.001, Code of Criminal Procedure, and the spouse or
2020 surviving spouse of the peace officer;
2121 (2) the adult child of a current peace officer as
2222 defined by Article 2A.001, Code of Criminal Procedure;
2323 (3) a current or honorably retired county jailer as
2424 defined by Section 1701.001, Occupations Code;
2525 (4) an employee of the Texas Department of Criminal
2626 Justice;
2727 (5) a commissioned security officer as defined by
2828 Section 1702.002, Occupations Code;
2929 (6) an individual who shows that the individual, the
3030 individual's child, or another person in the individual's household
3131 is a victim of family violence as defined by Section 71.004, Family
3232 Code, by providing:
3333 (A) a copy of a protective order issued under
3434 Chapter 85, Family Code, or a magistrate's order for emergency
3535 protection issued under Article 17.292, Code of Criminal Procedure;
3636 or
3737 (B) other independent documentary evidence
3838 necessary to show that the individual, the individual's child, or
3939 another person in the individual's household is a victim of family
4040 violence;
4141 (7) an individual who shows that the individual, the
4242 individual's child, or another person in the individual's household
4343 is a victim of sexual assault or abuse, stalking, or trafficking of
4444 persons by providing:
4545 (A) a copy of a protective order issued under
4646 Subchapter A or B, Chapter 7B, Code of Criminal Procedure, or a
4747 magistrate's order for emergency protection issued under Article
4848 17.292, Code of Criminal Procedure; or
4949 (B) other independent documentary evidence
5050 necessary to show that the individual, the individual's child, or
5151 another person in the individual's household is a victim of sexual
5252 assault or abuse, stalking, or trafficking of persons;
5353 (8) a participant in the address confidentiality
5454 program administered by the attorney general under Subchapter B,
5555 Chapter 58, Code of Criminal Procedure, who provides proof of
5656 certification under Article 58.059, Code of Criminal Procedure;
5757 (9) a federal judge, a federal bankruptcy judge, a
5858 marshal of the United States Marshals Service, a state judge, or a
5959 family member of a federal judge, a federal bankruptcy judge, a
6060 marshal of the United States Marshals Service, or a state judge;
6161 (10) a current or former district attorney, criminal
6262 district attorney, or county or municipal attorney whose
6363 jurisdiction includes any criminal law or child protective services
6464 matters;
6565 (11) a current or former employee of a district
6666 attorney, criminal district attorney, or county or municipal
6767 attorney whose jurisdiction includes any criminal law or child
6868 protective services matters;
6969 (12) an officer or employee of a community supervision
7070 and corrections department established under Chapter 76,
7171 Government Code, who performs a duty described by Section 76.004(b)
7272 of that code;
7373 (13) a criminal investigator of the United States as
7474 described by Article 2A.002(a), Code of Criminal Procedure;
7575 (14) a current or honorably retired police officer or
7676 inspector of the United States Federal Protective Service;
7777 (15) a current or former United States attorney,
7878 assistant United States attorney, federal public defender, deputy
7979 federal public defender, or assistant federal public defender and
8080 the spouse and child of the attorney or public defender;
8181 (16) a current or former employee of the office of the
8282 attorney general who is or was assigned to a division of that office
8383 the duties of which involve law enforcement or are performed under
8484 Chapter 231, Family Code;
8585 (17) a medical examiner or person who performs
8686 forensic analysis or testing who is employed by this state or one or
8787 more political subdivisions of this state;
8888 (18) a current or former member of the United States
8989 armed forces who has served in an area that the president of the
9090 United States by executive order designates for purposes of 26
9191 U.S.C. Section 112 as an area in which armed forces of the United
9292 States are or have engaged in combat;
9393 (19) a current or former employee of the Texas
9494 Juvenile Justice Department or of the predecessors in function of
9595 the department;
9696 (20) a current or former juvenile probation or
9797 supervision officer certified by the Texas Juvenile Justice
9898 Department, or the predecessors in function of the department,
9999 under Title 12, Human Resources Code;
100100 (21) a current or former employee of a juvenile
101101 justice program or facility, as those terms are defined by Section
102102 261.405, Family Code;
103103 (22) a current or former employee of the Texas Civil
104104 Commitment Office or the predecessor in function of the office or a
105105 division of the office;
106106 (23) a current or former employee of a federal judge or
107107 state judge;
108108 (24) a current or former child protective services
109109 caseworker, adult protective services caseworker, or investigator
110110 for the Department of Family and Protective Services or a current or
111111 former employee of a department contractor performing child
112112 protective services caseworker, adult protective services
113113 caseworker, or investigator functions for the contractor on behalf
114114 of the department;
115115 (25) an elected public officer;
116116 (26) a firefighter or volunteer firefighter or
117117 emergency medical services personnel as defined by Section 773.003,
118118 Health and Safety Code;
119119 (27) a customs and border protection officer or border
120120 patrol agent of United States Customs and Border Protection or the
121121 spouse, surviving spouse, or adult child of a customs and border
122122 protection officer or border patrol agent;
123123 (28) [(27) a current or former attorney for the
124124 Department of Family and Protective Services
125125 [(27)] a current or former employee or contract staff
126126 member of a university health care provider at a corrections
127127 facility operated by the Texas Department of Criminal Justice or
128128 the Texas Juvenile Justice Department; [and]
129129 (29) [(28)] a current or former attorney for the
130130 Department of Family and Protective Services; and
131131 (30) an employee of a school district or of an
132132 open-enrollment charter school or private school as defined by
133133 Section 5.001, Education Code.
134134 SECTION 2. To the extent of any conflict, this Act prevails
135135 over another Act of the 89th Legislature, Regular Session, 2025,
136136 relating to nonsubstantive additions to and corrections in enacted
137137 codes.
138138 SECTION 3. This Act takes effect immediately if it receives
139139 a vote of two-thirds of all the members elected to each house, as
140140 provided by Section 39, Article III, Texas Constitution. If this
141141 Act does not receive the vote necessary for immediate effect, this
142142 Act takes effect September 1, 2025.
