77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to civil and criminal liability for engaging in certain
1010 conduct involving a critical infrastructure facility; creating
1111 criminal offenses.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Section 424.001, Government Code, is amended to
1414 read as follows:
1515 Sec. 424.001. DEFINITIONS [DEFINITION]. In this
1616 chapter:
1717 (1) "Critical [, "critical] infrastructure facility"
1818 has the meaning assigned by Section 423.0045(a)(1-a) and also
1919 includes:
2020 (A) [(1)] any pipeline transporting oil or gas or
2121 the products or constituents of oil or gas;
2222 (B) [(2)] a public or private airport depicted in
2323 any current aeronautical chart published by the Federal Aviation
2424 Administration;
2525 (C) [(3)] a military installation owned or
2626 operated by or for the federal government, this state, or another
2727 governmental entity;
2828 (D) a semiconductor wafer manufacturing
2929 facility; and
3030 (E) [(4)] a facility or pipeline described by
3131 this section that is under construction and all equipment and
3232 appurtenances used during that construction.
3333 (2) "Semiconductor wafer manufacturing facility"
3434 means a manufacturing facility that includes any of the following
3535 processes with respect to semiconductor production:
3636 (A) growing single-crystal ingots or boules;
3737 (B) wafer slicing;
3838 (C) etching and polishing;
3939 (D) bonding;
4040 (E) cleaning;
4141 (F) epitaxial deposition; or
4242 (G) metrology.
4343 SECTION 2. Section 424.051(a), Government Code, is amended
4444 to read as follows:
4545 (a) A person commits an offense if, without the effective
4646 consent of the owner, the person:
4747 (1) enters or remains on or in a critical
4848 infrastructure facility and intentionally or knowingly damages or
4949 destroys the facility; or
5050 (2) intentionally or knowingly disturbs the physical
5151 environment, including increasing ground or subterranean vibration
5252 levels, within 15 miles of a critical infrastructure facility and
5353 the disturbance damages or destroys the facility.
5454 SECTION 3. Section 424.052(a), Government Code, is amended
5555 to read as follows:
5656 (a) A person commits an offense if, without the effective
5757 consent of the owner, the person:
5858 (1) enters or remains on or in a critical
5959 infrastructure facility and intentionally or knowingly impairs or
6060 interrupts the operation of the facility; or
6161 (2) intentionally or knowingly disturbs the physical
6262 environment, including increasing ground or subterranean vibration
6363 levels, within 15 miles of a critical infrastructure facility and
6464 the disturbance impairs or interrupts the operation of the
6565 facility.
6666 SECTION 4. Section 424.053(a), Government Code, is amended
6767 to read as follows:
6868 (a) A person commits an offense if, without the effective
6969 consent of the owner, the person:
7070 (1) enters or remains on or in a critical
7171 infrastructure facility with the intent to damage or destroy the
7272 facility; or
7373 (2) disturbs the physical environment, including
7474 increasing ground or subterranean vibration levels, within 15 miles
7575 of a critical infrastructure facility with the intent to damage or
7676 destroy the facility.
7777 SECTION 5. Section 424.054(a), Government Code, is amended
7878 to read as follows:
7979 (a) A person commits an offense if, without the effective
8080 consent of the owner, the person:
8181 (1) enters or remains on or in a critical
8282 infrastructure facility with the intent to impair or interrupt the
8383 operation of the facility; or
8484 (2) disturbs the physical environment, including
8585 increasing ground or subterranean vibration levels, within 15 miles
8686 of a critical infrastructure facility with the intent to impair or
8787 interrupt the operation of the facility.
8888 SECTION 6. Section 424.055, Government Code, is amended to
8989 read as follows:
9090 Sec. 424.055. PUNISHMENT FOR CORPORATIONS AND
9191 ASSOCIATIONS. Notwithstanding Section 12.51, Penal Code, a court
9292 shall sentence a corporation or association adjudged guilty of an
9393 offense under this subchapter to pay a fine not to exceed $1 billion
9494 [$500,000].
9595 SECTION 7. Section 424.102, Government Code, is amended to
9696 read as follows:
9797 Sec. 424.102. CERTAIN ADDITIONAL LIABILITY. In addition to
9898 any liability under Section 424.101, an organization that, acting
9999 through an officer, director, or other person serving in a
100100 managerial capacity, knowingly compensates a person for engaging in
101101 conduct occurring on the premises of a critical infrastructure
102102 facility, or for disturbing the physical environment within 15
103103 miles of a critical infrastructure facility, is liable to the
104104 property owner, as provided by this subchapter, for damages arising
105105 from the conduct if the conduct constituted an offense under
106106 Section 424.051, 424.052, 424.053, or 424.054.
107107 SECTION 8. (a) The changes in law made by this Act to
108108 Chapter 424, Government Code, apply only to an offense committed on
109109 or after the effective date of this Act. An offense committed
110110 before the effective date of this Act is governed by the law in
111111 effect on the date the offense was committed, and the former law is
112112 continued in effect for that purpose. For purposes of this
113113 subsection, an offense was committed before the effective date of
114114 this Act if any element of the offense was committed before that
115115 date.
116116 (b) The changes in law made by this Act to Chapter 424,
117117 Government Code, apply only to a cause of action that accrues on or
118118 after the effective date of this Act. A cause of action that
119119 accrues before the effective date of this Act is governed by the law
120120 in effect on the date the cause of action accrued, and the former
121121 law is continued in effect for that purpose.
122122 SECTION 9. This Act takes effect September 1, 2025.
