88 AN ACT
99 relating to the establishment of an early childhood mental health
1010 home visiting grant program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 137, Human Resources Code, is amended by
1313 adding Subchapter G to read as follows:
1414 SUBCHAPTER G. EARLY CHILDHOOD MENTAL HEALTH HOME VISITING GRANT
1515 PROGRAM
1616 Sec. 137.301. ESTABLISHMENT AND OPERATION OF EARLY
1717 CHILDHOOD MENTAL HEALTH HOME VISITING GRANT PROGRAM. (a) The
1818 commission shall establish and operate an early childhood mental
1919 health home visiting grant program through which the commission
2020 will award grants to implement, expand, and maintain early
2121 childhood mental health home visiting services in this state to
2222 support families with a high level of need, including a history of
2323 trauma.
2424 (b) To be eligible for a grant under this subchapter, an
2525 applicant must:
2626 (1) demonstrate a commitment to a family-centered,
2727 system of care approach to providing comprehensive, coordinated
2828 services to children and families; and
2929 (2) have experience providing successful early
3030 childhood mental health or prevention services for low-income,
3131 high-risk families, as the executive commissioner determines by
3232 rule.
3333 (c) In awarding a grant under this subchapter, the
3434 commission shall give preference to applicants with experience in
3535 providing home-based services to children and families.
3636 (d) The commission may award a grant under this subchapter
3737 only in accordance with a contract between the commission and grant
3838 recipient. The contract must include provisions under which the
3939 commission is granted sufficient control to ensure the public
4040 purpose of providing early childhood mental health home visiting
4141 services is accomplished and this state receives the return
4242 benefit.
4343 Sec. 137.302. STANDARDS AND REQUIREMENTS. (a) The
4444 executive commissioner by rule shall adopt standards for grant
4545 recipients under this subchapter. In adopting the standards, the
4646 executive commissioner shall take into consideration applicable
4747 evidence-based early childhood home visiting service delivery
4848 models.
4949 (b) In addition to meeting the standards the executive
5050 commissioner adopts under Subsection (a), a grant recipient under
5151 this subchapter must:
5252 (1) strictly adhere to an evidence-based early
5353 childhood service delivery model the commission selects in
5454 accordance with criteria set by the United States Department of
5555 Health and Human Services for an early childhood home visiting
5656 service delivery model; and
5757 (2) require that a team consisting of a licensed
5858 mental health professional and a care coordinator support families
5959 through home-based services to:
6060 (A) improve child and parent mental health;
6161 (B) promote school readiness;
6262 (C) decrease child abuse and neglect; and
6363 (D) improve the immediate and long-term health
6464 and well-being of families.
6565 Sec. 137.303. FUNDING. The commission may solicit,
6666 contract for, receive, accept, or administer gifts, grants, and
6767 donations of money or property from any source to carry out this
6868 subchapter.
6969 Sec. 137.304. RULES. The executive commissioner may adopt
7070 rules as necessary to implement this subchapter.
7171 SECTION 2. This Act takes effect September 1, 2025.
