11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Chapter 437, Health and Safety Code, is amended |
---|
13 | 13 | | by adding Section 437.029 to read as follows: |
---|
14 | 14 | | Sec. 437.029. IMPORTED SHRIMP NOTICE. (a) For purposes of |
---|
15 | 15 | | this section, a shrimp caught in the Gulf of Mexico is considered to |
---|
16 | 16 | | be imported from outside of this state if the shrimp is caught |
---|
17 | 17 | | outside of the state-owned submerged lands described by Section |
---|
18 | 18 | | 11.012, Natural Resources Code. |
---|
19 | 19 | | (b) A food service establishment serving shrimp imported |
---|
20 | 20 | | from outside of this state shall provide to customers of the |
---|
21 | 21 | | establishment notice of the shrimp's importation. The |
---|
22 | 22 | | establishment must provide the notice by: |
---|
23 | 23 | | (1) posting the notice in a conspicuous place in an |
---|
24 | 24 | | area of the establishment accessible to the customers; or |
---|
25 | 25 | | (2) placing the notice on the establishment's food |
---|
26 | 26 | | menu. |
---|
27 | 27 | | (c) The executive commissioner shall adopt rules necessary |
---|
28 | 28 | | to implement this section. |
---|
29 | 29 | | SECTION 2. Notwithstanding Section 437.029, Health and |
---|
30 | 30 | | Safety Code, as added by this Act, a food service establishment is |
---|
31 | 31 | | not required to comply with that section before March 1, 2026. |
---|
32 | 32 | | SECTION 3. This Act takes effect September 1, 2025. |
