88 AN ACT
99 relating to notice provided by food service establishments serving
1010 shrimp imported from outside of this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 437, Health and Safety Code, is amended
1313 by adding Section 437.029 to read as follows:
1414 Sec. 437.029. IMPORTED SHRIMP NOTICE. (a) For purposes of
1515 this section, a shrimp caught in the Gulf of Mexico is considered to
1616 be imported from outside of this state if the shrimp is caught
1717 outside of the state-owned submerged lands described by Section
1818 11.012, Natural Resources Code.
1919 (b) A food service establishment serving shrimp imported
2020 from outside of this state shall provide to customers of the
2121 establishment notice of the shrimp's importation. The
2222 establishment must provide the notice by:
2323 (1) posting the notice in a conspicuous place in an
2424 area of the establishment accessible to the customers; or
2525 (2) placing the notice on the establishment's food
2626 menu.
2727 (c) The executive commissioner shall adopt rules necessary
2828 to implement this section.
2929 SECTION 2. Notwithstanding Section 437.029, Health and
3030 Safety Code, as added by this Act, a food service establishment is
3131 not required to comply with that section before March 1, 2026.
3232 SECTION 3. This Act takes effect September 1, 2025.
