9 | 9 | | relating to abolishing certain county boards of education, boards |

10 | 10 | | of county school trustees, and offices of county school |
---|
11 | 11 | | superintendent. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. (a) Each county board of education, board of |
---|
14 | 14 | | county school trustees, and office of county school superintendent |
---|
15 | 15 | | in a county with a population of 3.3 million or more is abolished |
---|
16 | 16 | | effective September 1, 2025. |
---|
17 | 17 | | (b) All assets, liabilities, and contracts of a board |
---|
18 | 18 | | abolished by this Act are transferred to the commissioners court of |
---|
19 | 19 | | the county in trust for the component school districts in the |
---|
20 | 20 | | county. The commissioners court shall, not later than September 1, |
---|
21 | 21 | | 2026, distribute the assets remaining after discharge of the |
---|
22 | 22 | | board's liabilities to the component school districts in the county |
---|
23 | 23 | | in proportionate shares equal to the proportion that the membership |
---|
24 | 24 | | in each district bears to total membership in the county as of May |
---|
25 | 25 | | 1, 2025. The commissioners court may liquidate board assets as |
---|
26 | 26 | | necessary to discharge board liabilities and facilitate the |
---|
27 | 27 | | distribution of assets. A person authorized by the board shall |
---|
28 | 28 | | execute any documents necessary to complete the transfer of assets, |
---|
29 | 29 | | liabilities, or contracts. |
---|
30 | 30 | | (c) The component school districts of a board abolished by |
---|
31 | 31 | | this Act shall collect and use any delinquent taxes imposed by the |
---|
32 | 32 | | board in the manner provided by rule of the commissioner of |
---|
33 | 33 | | education. |
---|
34 | 34 | | SECTION 2. Section 52.092(e), Election Code, is amended to |
---|
35 | 35 | | read as follows: |
---|
36 | 36 | | (e) County offices shall be listed in the following order: |
---|
37 | 37 | | (1) county judge; |
---|
38 | 38 | | (2) judge, county court at law; |
---|
39 | 39 | | (3) judge, county criminal court; |
---|
40 | 40 | | (4) judge, county probate court; |
---|
41 | 41 | | (5) county attorney; |
---|
42 | 42 | | (6) district clerk; |
---|
43 | 43 | | (7) district and county clerk; |
---|
44 | 44 | | (8) county clerk; |
---|
45 | 45 | | (9) sheriff; |
---|
46 | 46 | | (10) sheriff and tax assessor-collector; |
---|
47 | 47 | | (11) county tax assessor-collector; |
---|
48 | 48 | | (12) county treasurer; |
---|
49 | 49 | | (13) [county school trustee (county with population of |
---|
50 | 50 | | 3.3 million or more); |
---|
51 | 51 | | [(14)] county surveyor. |

52 | 52 | | SECTION 3. Chapter 595 (H.B. 689), Acts of the 59th |
---|
53 | 53 | | Legislature, Regular Session, 1965 (Article 2676c, Vernon's Texas |

54 | 54 | | Civil Statutes), is repealed. |

55 | 55 | | SECTION 4. This Act takes effect September 1, 2025. |
