77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to abolishing certain county boards of education, boards
1010 of county school trustees, and offices of county school
1111 superintendent.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. (a) Each county board of education, board of
1414 county school trustees, and office of county school superintendent
1515 in a county with a population of 3.3 million or more is abolished
1616 effective September 1, 2025.
1717 (b) All assets, liabilities, and contracts of a board
1818 abolished by this Act are transferred to the commissioners court of
1919 the county in trust for the component school districts in the
2020 county. The commissioners court shall, not later than September 1,
2121 2026, distribute the assets remaining after discharge of the
2222 board's liabilities to the component school districts in the county
2323 in proportionate shares equal to the proportion that the membership
2424 in each district bears to total membership in the county as of May
2525 1, 2025. The commissioners court may liquidate board assets as
2626 necessary to discharge board liabilities and facilitate the
2727 distribution of assets. A person authorized by the board shall
2828 execute any documents necessary to complete the transfer of assets,
2929 liabilities, or contracts.
3030 (c) The component school districts of a board abolished by
3131 this Act shall collect and use any delinquent taxes imposed by the
3232 board in the manner provided by rule of the commissioner of
3333 education.
3434 SECTION 2. Section 52.092(e), Election Code, is amended to
3535 read as follows:
3636 (e) County offices shall be listed in the following order:
3737 (1) county judge;
3838 (2) judge, county court at law;
3939 (3) judge, county criminal court;
4040 (4) judge, county probate court;
4141 (5) county attorney;
4242 (6) district clerk;
4343 (7) district and county clerk;
4444 (8) county clerk;
4545 (9) sheriff;
4646 (10) sheriff and tax assessor-collector;
4747 (11) county tax assessor-collector;
4848 (12) county treasurer;
4949 (13) [county school trustee (county with population of
5050 3.3 million or more);
5151 [(14)] county surveyor.
5252 SECTION 3. Chapter 595 (H.B. 689), Acts of the 59th
5353 Legislature, Regular Session, 1965 (Article 2676c, Vernon's Texas
5454 Civil Statutes), is repealed.
5555 SECTION 4. This Act takes effect September 1, 2025.
