77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to proof of the identity of a child's parents in a suit
1010 affecting the parent-child relationship.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 102.008, Family Code, is amended by
1313 adding Subsection (c-1) and amending Subsection (d) to read as
1414 follows:
1515 (c-1) The petitioner shall additionally submit to the court
1616 a certified copy of the child's birth certificate if available to
1717 the petitioner. If a certified copy of the child's birth
1818 certificate is not available to the petitioner, the court at any
1919 time during the pendency of the suit may request another party to
2020 whom a certified copy of the child's birth certificate is available
2121 to submit a copy to the court. If a certified copy of the child's
2222 birth certificate is not available to any party or if the copy does
2323 not name both of the child's parents, the court may request from any
2424 party at any time during the pendency of the suit alternative proof
2525 of the identity of the child's parents. The court shall keep
2626 confidential any certificate or other proof submitted under this
2727 subsection.
2828 (d) Notwithstanding any other provision of this section, if
2929 the Title IV-D agency files a petition in a suit affecting the
3030 parent-child relationship, the agency is not required to:
3131 (1) include in the petition the statement described by
3232 Subsection (b)(11); [or]
3333 (2) attach copies of the documentation described by
3434 Subsection (c); or
3535 (3) submit to the court a copy of a child's birth
3636 certificate or other proof of the identity of the child's parents as
3737 described by Subsection (c-1).
3838 SECTION 2. The change in law made by this Act applies to a
3939 suit affecting the parent-child relationship that is filed on or
4040 after the effective date of this Act. A suit affecting the
4141 parent-child relationship filed before the effective date of this
4242 Act is governed by the law in effect on the date the suit was filed,
4343 and the former law is continued in effect for that purpose.
4444 SECTION 3. This Act takes effect September 1, 2025.
