77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the age limit for a beginning position in a fire
1010 department under municipal civil service.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 143.023(a) and (b), Local Government
1313 Code, are amended to read as follows:
1414 (a) A person may not take an entrance examination for a
1515 beginning position in a [the] police or fire department unless the
1616 person is at least 18 years of age. [A person may not take an
1717 entrance examination for a beginning position in the fire
1818 department unless the person is at least 18 years of age but not 36
1919 years of age or older.]
2020 (b) A person may not be certified as eligible for a
2121 beginning position in a fire department if the person is 45 [36]
2222 years of age or older.
2323 SECTION 2. Section 143.083(a), Local Government Code, is
2424 amended to read as follows:
2525 (a) If a municipality is unable to recruit qualified fire
2626 fighters because of the maximum age limit prescribed by Section
2727 143.023 and the municipality's governing body finds that this
2828 inability creates an emergency, the commission shall recommend to
2929 the governing body additional rules governing the temporary
3030 employment of persons who are 45 [36] years of age or older.
3131 SECTION 3. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2025.
