77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the disclosure of certain information by the Texas
1010 Juvenile Justice Department.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 244.003, Human Resources Code, is
1313 amended by amending Subsection (b) and adding Subsection (c) to
1414 read as follows:
1515 (b) Except as provided by Section 243.051(c), these records
1616 and all other information concerning a child, including personally
1717 identifiable information, are not public and are available only
1818 according to the provisions of Subsection (c) of this section,
1919 Section 58.005, Family Code, Section 244.051 of this code, and
2020 Chapter 67, Code of Criminal Procedure.
2121 (c) The department may disclose information concerning a
2222 person who was committed to the department, including personally
2323 identifiable information, if:
2424 (1) the person:
2525 (A) has been discharged from commitment by the
2626 department;
2727 (B) is at least 18 years of age; and
2828 (C) has given consent for the department to
2929 disclose the information; and
3030 (2) the department does not disclose any information
3131 for which the person did not consent to disclosure and does not
3232 disclose any information for a purpose other than the purpose for
3333 which the person consented to disclosure.
3434 SECTION 2. This Act takes effect September 1, 2025.
