9 | 9 | | relating to the maximum amount of unemployment benefits payable to |

10 | 10 | | an individual during a benefit year under the state unemployment |
---|
11 | 11 | | insurance program. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
13 | 13 | | SECTION 1. Subchapter A, Chapter 207, Labor Code, is |
---|
14 | 14 | | amended by adding Section 207.0055 to read as follows: |
---|
15 | 15 | | Sec. 207.0055. MAXIMUM AMOUNT OF BENEFITS; SLIDING SCALE. |
---|
16 | 16 | | (a) In this section, "state average unemployment rate" means the |
---|
17 | 17 | | average seasonally adjusted unemployment rate in this state, as |
---|
18 | 18 | | published by the United States Bureau of Labor Statistics, during |
---|
19 | 19 | | the most recent completed calendar year quarter preceding the first |
---|
20 | 20 | | day of an individual's benefit year. |
---|
21 | 21 | | (b) The maximum amount of benefits payable to an eligible |
---|
22 | 22 | | individual during a benefit year is an amount determined by the |
---|
23 | 23 | | state average unemployment rate on a sliding scale as follows: |
---|
24 | 24 | | (1) 14 times the individual's benefit amount, if the |
---|
25 | 25 | | rate is not greater than 6.5 percent; |
---|
26 | 26 | | (2) 15 times the individual's benefit amount, if the |
---|
27 | 27 | | rate is at least 6.6 percent but not greater than 7 percent; |
---|
28 | 28 | | (3) 16 times the individual's benefit amount, if the |
---|
29 | 29 | | rate is at least 7.1 percent but not greater than 7.5 percent; |
---|
30 | 30 | | (4) 17 times the individual's benefit amount, if the |
---|
31 | 31 | | rate is at least 7.6 percent but not greater than 8 percent; |
---|
32 | 32 | | (5) 18 times the individual's benefit amount, if the |
---|
33 | 33 | | rate is at least 8.1 percent but not greater than 8.5 percent; |
---|
34 | 34 | | (6) 19 times the individual's benefit amount, if the |
---|
35 | 35 | | rate is at least 8.6 percent but not greater than 9 percent; |
---|
36 | 36 | | (7) 20 times the individual's benefit amount, if the |
---|
37 | 37 | | rate is greater than 9 percent but not greater than 9.5 percent; |
---|
38 | 38 | | (8) 21 times the individual's benefit amount, if the |
---|
39 | 39 | | rate is at least 9.6 percent but not greater than 10 percent; and |
---|
40 | 40 | | (9) 27 times the individual's benefit amount, if the |
---|
41 | 41 | | rate is greater than 10 percent. |
---|
42 | 42 | | SECTION 2. Section 215.043(a), Labor Code, is amended to |
---|
43 | 43 | | read as follows: |
---|
44 | 44 | | (a) An individual is not entitled to receive shared work |
---|
45 | 45 | | benefits and regular unemployment compensation benefits that |
---|
46 | 46 | | exceed the maximum total benefits payable to the individual in a |
---|
47 | 47 | | benefit year as provided by Section 207.0055 [207.005]. |
---|
48 | 48 | | SECTION 3. Section 207.005, Labor Code, is repealed. |
---|
49 | 49 | | SECTION 4. The changes in law made by this Act apply only to |
---|
50 | 50 | | a claim for unemployment compensation benefits filed with the Texas |
---|
51 | 51 | | Workforce Commission on or after the effective date of this Act. A |
---|
52 | 52 | | claim filed before the effective date of this Act is governed by the |
---|
53 | 53 | | law in effect on the date the claim was filed, and the former law is |
---|
54 | 54 | | continued in effect for that purpose. |
---|
55 | 55 | | SECTION 5. This Act takes effect January 1, 2026. |
