77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the maximum amount of unemployment benefits payable to
1010 an individual during a benefit year under the state unemployment
1111 insurance program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 207, Labor Code, is
1414 amended by adding Section 207.0055 to read as follows:
1515 Sec. 207.0055. MAXIMUM AMOUNT OF BENEFITS; SLIDING SCALE.
1616 (a) In this section, "state average unemployment rate" means the
1717 average seasonally adjusted unemployment rate in this state, as
1818 published by the United States Bureau of Labor Statistics, during
1919 the most recent completed calendar year quarter preceding the first
2020 day of an individual's benefit year.
2121 (b) The maximum amount of benefits payable to an eligible
2222 individual during a benefit year is an amount determined by the
2323 state average unemployment rate on a sliding scale as follows:
2424 (1) 14 times the individual's benefit amount, if the
2525 rate is not greater than 6.5 percent;
2626 (2) 15 times the individual's benefit amount, if the
2727 rate is at least 6.6 percent but not greater than 7 percent;
2828 (3) 16 times the individual's benefit amount, if the
2929 rate is at least 7.1 percent but not greater than 7.5 percent;
3030 (4) 17 times the individual's benefit amount, if the
3131 rate is at least 7.6 percent but not greater than 8 percent;
3232 (5) 18 times the individual's benefit amount, if the
3333 rate is at least 8.1 percent but not greater than 8.5 percent;
3434 (6) 19 times the individual's benefit amount, if the
3535 rate is at least 8.6 percent but not greater than 9 percent;
3636 (7) 20 times the individual's benefit amount, if the
3737 rate is greater than 9 percent but not greater than 9.5 percent;
3838 (8) 21 times the individual's benefit amount, if the
3939 rate is at least 9.6 percent but not greater than 10 percent; and
4040 (9) 27 times the individual's benefit amount, if the
4141 rate is greater than 10 percent.
4242 SECTION 2. Section 215.043(a), Labor Code, is amended to
4343 read as follows:
4444 (a) An individual is not entitled to receive shared work
4545 benefits and regular unemployment compensation benefits that
4646 exceed the maximum total benefits payable to the individual in a
4747 benefit year as provided by Section 207.0055 [207.005].
4848 SECTION 3. Section 207.005, Labor Code, is repealed.
4949 SECTION 4. The changes in law made by this Act apply only to
5050 a claim for unemployment compensation benefits filed with the Texas
5151 Workforce Commission on or after the effective date of this Act. A
5252 claim filed before the effective date of this Act is governed by the
5353 law in effect on the date the claim was filed, and the former law is
5454 continued in effect for that purpose.
5555 SECTION 5. This Act takes effect January 1, 2026.
