11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

12 | 12 | | SECTION 1. Subchapter B, Chapter 31, Human Resources Code, |
---|
13 | 13 | | is amended by adding Section 31.0321 to read as follows: |
---|
14 | 14 | | Sec. 31.0321. ELIGIBILITY FOLLOWING CERTAIN CRIMINAL |
---|
15 | 15 | | CONVICTIONS. As authorized by 21 U.S.C. Section 862a(d)(1)(A), 21 |
---|
16 | 16 | | U.S.C. Section 862a(a) does not apply in determining the |
---|
17 | 17 | | eligibility of any person for financial assistance. |
---|
18 | 18 | | SECTION 2. Section 33.018(a), Human Resources Code, is |
---|
19 | 19 | | amended to read as follows: |
---|
20 | 20 | | (a) As authorized by 21 U.S.C. Section 862a(d)(1)(A) |
---|
21 | 21 | | [862a(d)(1) and except as provided by this section], 21 U.S.C. |
---|
22 | 22 | | Section 862a(a) [862a(a)(2)] does not apply in determining the |
---|
23 | 23 | | eligibility of any person for the supplemental nutrition assistance |
---|
24 | 24 | | program. |
---|
25 | 25 | | SECTION 3. Sections 33.018(b) and (c), Human Resources |
---|
26 | 26 | | Code, are repealed. |
---|
27 | 27 | | SECTION 4. The changes in law made by this Act apply only to |
---|
28 | 28 | | an initial determination or redetermination of eligibility of a |
---|
29 | 29 | | person for financial assistance under Chapter 31, Human Resources |
---|
30 | 30 | | Code, or supplemental nutrition assistance program benefits under |
---|
31 | 31 | | Chapter 33, Human Resources Code, made on or after the effective |
---|
32 | 32 | | date of this Act. |
---|
33 | 33 | | SECTION 5. If before implementing any provision of this Act |
---|
34 | 34 | | a state agency determines that a waiver or authorization from a |
---|
35 | 35 | | federal agency is necessary for implementation of that provision, |
---|
36 | 36 | | the agency affected by the provision shall request the waiver or |
---|
37 | 37 | | authorization and may delay implementing that provision until the |
---|
38 | 38 | | waiver or authorization is granted. |
---|
39 | 39 | | SECTION 6. This Act takes effect September 1, 2025. |
