77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to increasing the criminal penalties for insider trading
1010 and other misuse of official information.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 39.06, Penal Code, is amended by
1313 amending Subsection (e) and adding Subsection (g) to read as
1414 follows:
1515 (e) Except as provided by Subsection (g) [(f)], an offense
1616 under this section is a felony of the third degree.
1717 (g) If the commission of an offense under this section
1818 results in a net pecuniary gain to the person committing the
1919 offense, the offense is:
2020 (1) a felony of the third degree if the net pecuniary
2121 gain is less than $150,000;
2222 (2) a felony of the second degree if the net pecuniary
2323 gain is $150,000 or more but less than $300,000; or
2424 (3) a felony of the first degree if the net pecuniary
2525 gain is $300,000 or more.
2626 SECTION 2. Section 39.06(f), Penal Code, is repealed.
2727 SECTION 3. The change in law made by this Act applies only
2828 to an offense committed on or after the effective date of this Act.
2929 An offense committed before the effective date of this Act is
3030 governed by the law in effect on the date the offense was committed,
3131 and the former law is continued in effect for that purpose. For
3232 purposes of this section, an offense was committed before the
3333 effective date of this Act if any element of the offense occurred
3434 before that date.
3535 SECTION 4. This Act takes effect September 1, 2025.
