57 A BILL TO BE ENTITLED
68 AN ACT
79 relating to the eligibility of an organization to receive surplus
810 agricultural products under certain grants awarded by the
911 Department of Agriculture.
1012 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1113 SECTION 1. Section 21.002, Agriculture Code, is amended to
1214 read as follows:
1315 Sec. 21.002. ELIGIBILITY. Subject to available funds, a
1416 nonprofit organization is eligible to receive a grant under this
1517 chapter if the organization:
1618 (1) has at least five years of experience coordinating
1719 a statewide network of food banks and charitable organizations that
1820 serve each county of this state;
1921 (2) operates a program that coordinates the collection
2022 and transportation of surplus agricultural products to [a statewide
2123 network of] food banks in this state that provide food to needy or
2224 low-income individuals; and
2325 (3) submits to the department, in the manner and time
2426 prescribed by the department, a proposal for the collection and
2527 distribution to food banks or other charitable organizations for
2628 use in providing food to needy or low-income individuals of surplus
2729 agricultural products, including:
2830 (A) a description of the proposal;
2931 (B) a schedule of projected costs for the
3032 proposal;
3133 (C) measurable goals for the proposal; and
3234 (D) a plan for evaluating the success of the
3335 proposal.
3436 SECTION 2. Chapter 21, Agriculture Code, is amended by
3537 adding Section 21.004 to read as follows:
3638 Sec. 21.004. DISTRIBUTION OF RESOURCES TO FOOD BANKS. A
3739 nonprofit organization that receives a grant under this chapter
3840 must make surplus agricultural products and other grant resources
3941 available to any food bank operating in five or more counties in
4042 this state.
4143 SECTION 3. This Act takes effect September 1, 2025.
