77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a school district professional employee's liability for
1010 certain criminal conduct against a student.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 22.0511(a), Education Code, is amended
1313 to read as follows:
1414 (a) A professional employee of a school district is not
1515 personally liable for any act that is incident to or within the
1616 scope of the duties of the employee's position of employment and
1717 that involves the exercise of judgment or discretion on the part of
1818 the employee, except in circumstances in which a professional
1919 employee:
2020 (1) uses excessive force in the discipline of students
2121 or negligence resulting in bodily injury to students; or
2222 (2) commits an offense against a student:
2323 (A) under Chapter 19 or 20, Penal Code;
2424 (B) under Section 22.01(a)(1), 22.02, or 22.04,
2525 Penal Code; or
2626 (C) for which the employee would be required to
2727 register as a sex offender under Chapter 62, Code of Criminal
2828 Procedure.
2929 SECTION 2. This Act applies only to conduct that occurs on
3030 or after the effective date of this Act. Conduct that occurred
3131 before the effective date of this Act is governed by the law in
3232 effect on the date the conduct occurred, and the former law is
3333 continued in effect for that purpose.
3434 SECTION 3. This Act takes effect September 1, 2025.
