77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a limitation on the salary paid to officers and
1010 employees of this state and political subdivisions of this state.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter B, Chapter 659, Government Code, is
1313 amended by adding Section 659.0111 to read as follows:
1414 Sec. 659.0111. LIMITATION ON SALARY. Notwithstanding any
1515 other law, the salary of a state officer or employee may not exceed
1616 150 percent of the amount of the salary set by the biennial
1717 appropriations act for the governor.
1818 SECTION 2. Chapter 180, Local Government Code, is amended
1919 by adding Section 180.011 to read as follows:
2020 Sec. 180.011. LIMITATION ON SALARY FOR OFFICER OR EMPLOYEE
2121 OF POLITICAL SUBDIVISION. (a) In this section, "political
2222 subdivision" means a county, municipality, special district,
2323 school district, junior college district, or other political
2424 subdivision of this state.
2525 (b) Notwithstanding any other law, the salary of an officer
2626 or employee of a political subdivision may not exceed 150 percent of
2727 the amount of the salary set by the General Appropriations Act for
2828 the governor.
2929 SECTION 3. Section 659.0111, Government Code, and Section
3030 180.011, Local Government Code, as added by this Act, apply only to
3131 a salary agreement or employment contract entered into on or after
3232 the effective date of this Act. A salary agreement or employment
3333 contract entered into before the effective date of this Act is
3434 governed by the law in effect at the time the agreement or contract
3535 was entered into, and the former law is continued in effect for that
3636 purpose.
3737 SECTION 4. This Act applies beginning with the state fiscal
3838 biennium that begins September 1, 2025.
3939 SECTION 5. This Act takes effect September 1, 2025.
