| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Chapter 180, Local Government Code, is amended |
|---|
| 13 | 13 | | by adding Section 180.011 to read as follows: |
|---|
| 14 | 14 | | Sec. 180.011. ANNUAL OCCUPATIONAL MEDICAL EXAMINATION FOR |
|---|
| 15 | 15 | | FIRE FIGHTERS. (a) In this section: |
|---|
| 16 | 16 | | (1) "Fire department" has the meaning assigned by |
|---|
| 17 | 17 | | Section 419.021, Government Code. |
|---|
| 18 | 18 | | (2) "Fire fighter" means an individual: |
|---|
| 19 | 19 | | (A) defined as fire protection personnel under |
|---|
| 20 | 20 | | Section 419.021(3)(C), Government Code; and |
|---|
| 21 | 21 | | (B) who is certified by the Texas Commission on |
|---|
| 22 | 22 | | Fire Protection under Chapter 419 of that code. |
|---|
| 23 | 23 | | (b) A fire department shall offer an annual occupational |
|---|
| 24 | 24 | | medical examination to each fire fighter employed by the fire |
|---|
| 25 | 25 | | department at no cost to the fire fighter. |
|---|
| 26 | 26 | | (c) The annual occupational medical examination required |
|---|
| 27 | 27 | | under Subsection (b) must be confidential and include: |
|---|
| 28 | 28 | | (1) a blood test; |
|---|
| 29 | 29 | | (2) a urine test; |
|---|
| 30 | 30 | | (3) a pulmonary function test; |
|---|
| 31 | 31 | | (4) an electrocardiogram; |
|---|
| 32 | 32 | | (5) an infectious disease screening; |
|---|
| 33 | 33 | | (6) a cancer screening; and |
|---|
| 34 | 34 | | (7) a chest x-ray, subject to Subsection (d). |
|---|
| 35 | 35 | | (d) A fire fighter is eligible to receive a chest x-ray |
|---|
| 36 | 36 | | during an annual occupational medical examination required under |
|---|
| 37 | 37 | | Subsection (b) once every five years. |
|---|
| 38 | 38 | | (e) The Texas Commission on Fire Protection shall adopt |
|---|
| 39 | 39 | | rules establishing minimum standards for annual occupational |
|---|
| 40 | 40 | | medical examinations required under Subsection (b) by using |
|---|
| 41 | 41 | | standards developed by the National Fire Protection Association. |
|---|
| 42 | 42 | | (f) A fire department is not required to offer an annual |
|---|
| 43 | 43 | | occupational medical examination under Subsection (b) if the fire |
|---|
| 44 | 44 | | department offers an annual occupational medical examination under |
|---|
| 45 | 45 | | an annual occupational medical examination plan submitted to the |
|---|
| 46 | 46 | | Texas Commission on Fire Protection by February 1 of each year. The |
|---|
| 47 | 47 | | plan must be endorsed by a physician and be in substantial |
|---|
| 48 | 48 | | compliance with standards developed by the National Fire Protection |
|---|
| 49 | 49 | | Association. The commission shall adopt rules to implement this |
|---|
| 50 | 50 | | subsection. |
|---|
| 51 | 51 | | SECTION 2. As soon as practicable after the effective date |
|---|
| 52 | 52 | | of this Act but not later than January 1, 2027, the Texas Commission |
|---|
| 53 | 53 | | on Fire Protection shall adopt rules as required by Sections |
|---|
| 54 | 54 | | 180.011(e) and (f), Local Government Code, as added by this Act. |
|---|
| 55 | 55 | | SECTION 3. A fire department is not required to comply with |
|---|
| 56 | 56 | | Section 180.011, Local Government Code, as added by this Act, until |
|---|
| 57 | 57 | | February 1, 2027. |
|---|
| 58 | 58 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 59 | 59 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 60 | 60 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 61 | 61 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 62 | 62 | | Act takes effect September 1, 2025. |
