11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 285.001(a), Transportation Code, is | |
13 | 13 | amended to read as follows: | |
14 | 14 | (a) To promote the public safety, the commissioners court of | |
15 | 15 | a county with a population of more than 1.3 million and a county | |
16 | 16 | with a population of more than 600,000 that is adjacent to a county | |
17 | 17 | with a population of more than four million by order may regulate | |
18 | 18 | the following in the unincorporated area of the county if they occur | |
19 | 19 | on a public highway or road, in the right-of-way of a public highway | |
20 | 20 | or road, or in a parking lot: | |
21 | 21 | (1) the sale of items by a vendor of food or | |
22 | 22 | merchandise, including live animals; | |
23 | 23 | (2) the erection, maintenance, or placement of a | |
24 | 24 | structure by a vendor of food or merchandise, including live | |
25 | 25 | animals; and | |
26 | 26 | (3) the solicitation of money. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2025. |
