77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the consideration of water conservation by the Texas
1010 Commission on Environmental Quality when determining whether to
1111 grant or deny a petition for the creation of a municipal utility
1212 district.
1313 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1414 SECTION 1. Section 54.015, Water Code, is amended to read as
1515 follows:
1616 Sec. 54.015. CONTENTS OF PETITION. The petition shall:
1717 (1) describe the boundaries of the proposed district
1818 by metes and bounds or by lot and block number, if there is a
1919 recorded map or plat and survey of the area;
2020 (2) state the general nature of the work proposed to be
2121 done, the necessity for the work, and the cost of the project as
2222 then estimated by those filing the petition; [and]
2323 (3) include a water conservation plan that meets the
2424 requirements of Section 13.146, regardless of whether that section
2525 applies to the district; and
2626 (4) include a name of the district which shall be
2727 generally descriptive of the locale of the district followed by the
2828 words Municipal Utility District, or if a district is located
2929 within one county, it may be designated "__________ County
3030 Municipal Utility District No. ______." (Insert the name of the
3131 county and proper consecutive number.) The proposed district shall
3232 not have the same name as any other district in the same county.
3333 SECTION 2. Section 54.021(b), Water Code, is amended to
3434 read as follows:
3535 (b) In determining if the project is feasible and
3636 practicable and if it is necessary and would be a benefit to the
3737 land included in the district, the commission shall consider:
3838 (1) the availability of comparable service from other
3939 systems, including but not limited to water districts,
4040 municipalities, and regional authorities;
4141 (2) the reasonableness of projected construction
4242 costs, tax rates, and water and sewer rates; and
4343 (3) whether or not the district and its system and
4444 subsequent development within the district will have an
4545 unreasonable effect on the following:
4646 (A) land elevation;
4747 (B) subsidence;
4848 (C) groundwater level within the region;
4949 (D) recharge capability of a groundwater source;
5050 (E) natural run-off rates and drainage;
5151 (F) water quality; [and]
5252 (G) water conservation; and
5353 (H) total tax assessments on all land located
5454 within a district.
5555 SECTION 3. This Act applies only to a petition requesting
5656 the creation of a municipal utility district that is filed with the
5757 Texas Commission on Environmental Quality on or after the effective
5858 date of this Act. A petition requesting the creation of a municipal
5959 utility district that was filed with the commission before the
6060 effective date of this Act is governed by the law in effect on the
6161 date the petition was filed, and the former law is continued in
6262 effect for that purpose.
6363 SECTION 4. This Act takes effect September 1, 2025.
