10 | 10 | | administered by the Texas Department of Housing and Community |

11 | 11 | | Affairs. |
---|
12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subchapter I, Chapter 2306, Government Code, is |
---|
14 | 14 | | amended by adding Section 2306.208 to read as follows: |
---|
15 | 15 | | Sec. 2306.208. HOUSING TEXAS FUND. (a) In this section, |
---|
16 | 16 | | "fund" means the housing Texas fund. |
---|
17 | 17 | | (b) The housing Texas fund is created as a special fund in |
---|
18 | 18 | | the state treasury. The Texas Department of Housing and Community |
---|
19 | 19 | | Affairs shall administer the fund. |
---|
20 | 20 | | (c) The fund consists of: |
---|
21 | 21 | | (1) money appropriated to the board for a purpose of |
---|
22 | 22 | | the fund; |
---|
23 | 23 | | (2) money the board transfers to the fund from any |
---|
24 | 24 | | available source; |
---|
25 | 25 | | (3) depository interest allocable to the fund and |
---|
26 | 26 | | other investment returns on money in the fund; |
---|
27 | 27 | | (4) money from gifts, grants, or donations to the |
---|
28 | 28 | | fund; and |
---|
29 | 29 | | (5) any other fees or sources of revenue that the |
---|
30 | 30 | | legislature may dedicate for deposit to the fund. |
---|
31 | 31 | | (d) Money in the fund may be used only as provided by this |
---|
32 | 32 | | section. The department shall allocate annual expenditures from |
---|
33 | 33 | | the fund as follows: |
---|
34 | 34 | | (1) 90 percent shall be used to provide grants to |
---|
35 | 35 | | nonprofit developers of multifamily affordable housing to develop, |
---|
36 | 36 | | maintain, and manage rental housing for individuals and families of |
---|
37 | 37 | | low income; |
---|
38 | 38 | | (2) nine percent shall be used to provide grants to |
---|
39 | 39 | | nonprofit entities that have demonstrated proficiency, as |
---|
40 | 40 | | established by department rule, in obtaining and maintaining stable |
---|
41 | 41 | | housing placements for individuals and families who have recently |
---|
42 | 42 | | experienced homelessness; and |
---|
43 | 43 | | (3) one percent shall be used to provide grants to |
---|
44 | 44 | | nonprofit entities to be used as one-time expenditures to: |
---|
45 | 45 | | (A) prevent an individual or family from becoming |
---|
46 | 46 | | homeless; or |
---|
47 | 47 | | (B) facilitate the ability of an individual or |
---|
48 | 48 | | family experiencing homelessness to transition quickly into a |
---|
49 | 49 | | stable housing placement. |
---|
50 | 50 | | (e) The department shall allocate grants under Subsection |
---|
51 | 51 | | (d)(2) in a manner that prioritizes in descending order nonprofit |
---|
52 | 52 | | entities that primarily provide services to: |
---|
53 | 53 | | (1) families with: |
---|
54 | 54 | | (A) a child under the age of 18; or |
---|
55 | 55 | | (B) a dependent with a disability; |
---|
56 | 56 | | (2) individuals recently released from prison or jail |
---|
57 | 57 | | after serving a sentence of confinement; and |
---|
58 | 58 | | (3) adults who are experiencing homelessness and who |
---|
59 | 59 | | do not have children. |
---|
60 | 60 | | (f) The department by rule shall provide for the manner in |
---|
61 | 61 | | which the assets of the fund may be used, subject to the limitations |
---|
62 | 62 | | provided by this section. |
---|
63 | 63 | | SECTION 2. This Act takes effect September 1, 2025. |
