77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of the housing Texas fund to be
1010 administered by the Texas Department of Housing and Community
1111 Affairs.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter I, Chapter 2306, Government Code, is
1414 amended by adding Section 2306.208 to read as follows:
1515 Sec. 2306.208. HOUSING TEXAS FUND. (a) In this section,
1616 "fund" means the housing Texas fund.
1717 (b) The housing Texas fund is created as a special fund in
1818 the state treasury. The Texas Department of Housing and Community
1919 Affairs shall administer the fund.
2020 (c) The fund consists of:
2121 (1) money appropriated to the board for a purpose of
2222 the fund;
2323 (2) money the board transfers to the fund from any
2424 available source;
2525 (3) depository interest allocable to the fund and
2626 other investment returns on money in the fund;
2727 (4) money from gifts, grants, or donations to the
2828 fund; and
2929 (5) any other fees or sources of revenue that the
3030 legislature may dedicate for deposit to the fund.
3131 (d) Money in the fund may be used only as provided by this
3232 section. The department shall allocate annual expenditures from
3333 the fund as follows:
3434 (1) 90 percent shall be used to provide grants to
3535 nonprofit developers of multifamily affordable housing to develop,
3636 maintain, and manage rental housing for individuals and families of
3737 low income;
3838 (2) nine percent shall be used to provide grants to
3939 nonprofit entities that have demonstrated proficiency, as
4040 established by department rule, in obtaining and maintaining stable
4141 housing placements for individuals and families who have recently
4242 experienced homelessness; and
4343 (3) one percent shall be used to provide grants to
4444 nonprofit entities to be used as one-time expenditures to:
4545 (A) prevent an individual or family from becoming
4646 homeless; or
4747 (B) facilitate the ability of an individual or
4848 family experiencing homelessness to transition quickly into a
4949 stable housing placement.
5050 (e) The department shall allocate grants under Subsection
5151 (d)(2) in a manner that prioritizes in descending order nonprofit
5252 entities that primarily provide services to:
5353 (1) families with:
5454 (A) a child under the age of 18; or
5555 (B) a dependent with a disability;
5656 (2) individuals recently released from prison or jail
5757 after serving a sentence of confinement; and
5858 (3) adults who are experiencing homelessness and who
5959 do not have children.
6060 (f) The department by rule shall provide for the manner in
6161 which the assets of the fund may be used, subject to the limitations
6262 provided by this section.
6363 SECTION 2. This Act takes effect September 1, 2025.
