10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
11 | 11 | SECTION 1. Subchapter C, Chapter 1369, Insurance Code, is | |
12 | 12 | amended by adding Section 1369.1035 to read as follows: | |
13 | 13 | Sec. 1369.1035. EMERGENCY CONTRACEPTIVE COVERAGE REQUIRED. | |
14 | 14 | (a) In this section, "emergency contraceptive" means a drug | |
15 | 15 | containing an elevated dose of hormones that: | |
16 | 16 | (1) is used postcoitally; | |
17 | 17 | (2) prevents pregnancy by preventing fertilization of | |
18 | 18 | an egg or preventing implantation of a fertilized egg in a uterus; | |
19 | 19 | and | |
20 | 20 | (3) is approved by the United States Food and Drug | |
21 | 21 | Administration. | |
22 | 22 | (b) A health benefit plan that provides coverage for | |
23 | 23 | prescription contraceptive drugs must provide coverage for | |
24 | 24 | emergency contraceptive drugs at least once per year without a | |
25 | 25 | prescription for each enrollee. | |
26 | 26 | SECTION 2. Section 1369.1035, Insurance Code, as added by | |
27 | 27 | this Act, applies only to a health benefit plan that is delivered, | |
28 | 28 | issued for delivery, or renewed on or after January 1, 2026. | |
29 | 29 | SECTION 3. This Act takes effect September 1, 2025. |
