77 AN ACT
88 relating to the coverage of emergency contraceptive drugs by health
99 benefit plans.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 1369, Insurance Code, is
1212 amended by adding Section 1369.1035 to read as follows:
1313 Sec. 1369.1035. EMERGENCY CONTRACEPTIVE COVERAGE REQUIRED.
1414 (a) In this section, "emergency contraceptive" means a drug
1515 containing an elevated dose of hormones that:
1616 (1) is used postcoitally;
1717 (2) prevents pregnancy by preventing fertilization of
1818 an egg or preventing implantation of a fertilized egg in a uterus;
1919 and
2020 (3) is approved by the United States Food and Drug
2121 Administration.
2222 (b) A health benefit plan that provides coverage for
2323 prescription contraceptive drugs must provide coverage for
2424 emergency contraceptive drugs at least once per year without a
2525 prescription for each enrollee.
2626 SECTION 2. Section 1369.1035, Insurance Code, as added by
2727 this Act, applies only to a health benefit plan that is delivered,
2828 issued for delivery, or renewed on or after January 1, 2026.
2929 SECTION 3. This Act takes effect September 1, 2025.
