77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the release of certain areas from a municipality's
1010 extraterritorial jurisdiction by petition or election.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 42.101, Local Government Code, is
1313 amended to read as follows:
1414 Sec. 42.101. APPLICABILITY. This subchapter does not apply
1515 to an area [located]:
1616 (1) located within five miles of the boundary of a
1717 military base, as defined by Section 43.0117, at which an active
1818 training program is conducted;
1919 (2) located in an area that was voluntarily annexed
2020 into the extraterritorial jurisdiction that is located in a county:
2121 (A) in which the population grew by more than 50
2222 percent from the previous federal decennial census in the federal
2323 decennial census conducted in 2020; and
2424 (B) that has a population greater than 240,000;
2525 (3) located within the portion of the extraterritorial
2626 jurisdiction of a municipality with a population of more than 1.4
2727 million that is:
2828 (A) within 15 miles of the boundary of a military
2929 base, as defined by Section 43.0117, at which an active training
3030 program is conducted; and
3131 (B) in a county with a population of more than two
3232 million;
3333 (4) located in an area designated as an industrial
3434 district under Section 42.044; [or]
3535 (5) [in an area] subject to a strategic partnership
3636 agreement entered into under Section 43.0751;
3737 (6) for which the release from a municipality's
3838 extraterritorial jurisdiction would result in the municipality's
3939 remaining extraterritorial jurisdiction not being contiguous; or
4040 (7) for which a municipality has spent at least $1
4141 million to develop.
4242 SECTION 2. Section 42.151, Local Government Code, is
4343 amended to read as follows:
4444 Sec. 42.151. APPLICABILITY. This subchapter does not apply
4545 to an area [located]:
4646 (1) located within five miles of the boundary of a
4747 military base, as defined by Section 43.0117, at which an active
4848 training program is conducted;
4949 (2) located in an area that was voluntarily annexed
5050 into the extraterritorial jurisdiction that is located in a county:
5151 (A) in which the population grew by more than 50
5252 percent from the previous federal decennial census in the federal
5353 decennial census conducted in 2020; and
5454 (B) that has a population greater than 240,000;
5555 (3) located within the portion of the extraterritorial
5656 jurisdiction of a municipality with a population of more than 1.4
5757 million that is:
5858 (A) within 15 miles of the boundary of a military
5959 base, as defined by Section 43.0117, at which an active training
6060 program is conducted; and
6161 (B) in a county with a population of more than two
6262 million;
6363 (4) located in an area designated as an industrial
6464 district under Section 42.044; [or]
6565 (5) [in an area] subject to a strategic partnership
6666 agreement entered into under Section 43.0751;
6767 (6) for which the release from a municipality's
6868 extraterritorial jurisdiction would result in the municipality's
6969 remaining extraterritorial jurisdiction not being contiguous; or
7070 (7) for which a municipality has spent at least $1
7171 million to develop.
7272 SECTION 3. The changes in law made by this Act apply only to
7373 the eligibility of an area to be released from a municipality's
7474 extraterritorial jurisdiction as the result of a petition filed
7575 under Subchapter D, Chapter 42, Local Government Code, or an
7676 election requested under Subchapter E of that chapter, as
7777 applicable, on or after the effective date of this Act.
7878 SECTION 4. This Act takes effect September 1, 2025.
