77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the provision of behavioral health services under the
1010 Medicaid managed care program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 540.0703(a), Government Code, as
1313 effective April 1, 2025, is amended to read as follows:
1414 (a) In this section:
1515 (1) "Behavioral [, "behavioral] health services"
1616 means mental health and substance use disorder services. The term
1717 includes intensive outpatient services and partial hospitalization
1818 services.
1919 (2) "Intensive outpatient services" means outpatient
2020 treatment services, including treatment services for substance use
2121 disorders, depression, eating disorders, and other mental health
2222 conditions that do not require detoxification or 24-hour
2323 supervision, provided to patients who require a time-limited,
2424 multifaceted array of services, structures, and supports by a team
2525 of clinical staff capable of providing, at a minimum, the following
2626 services:
2727 (A) individual counseling;
2828 (B) group counseling;
2929 (C) family counseling;
3030 (D) motivational enhancement training; and
3131 (E) relapse prevention, drug refusal, and coping
3232 skills training.
3333 (3) "Partial hospitalization services" means distinct
3434 and organized intensive ambulatory treatment services provided for
3535 periods of not more than 24 hours at a location other than a
3636 patient's home or in an inpatient or a residential care setting.
3737 The term includes the services described by 42 C.F.R. Section
3838 410.43(a)(4).
3939 SECTION 2. If before implementing any provision of this Act
4040 a state agency determines that a waiver or authorization from a
4141 federal agency is necessary for implementation of that provision,
4242 the agency affected by the provision shall request the waiver or
4343 authorization and may delay implementing that provision until the
4444 waiver or authorization is granted.
4545 SECTION 3. This Act takes effect September 1, 2025.
