99 relating to the total annual salary from state and county sources
1010 for certain state prosecutors.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 46.003, Government Code, is amended by
1313 amending Subsection (c) and adding Subsection (c-1) to read as
1414 follows:
1515 (c) Notwithstanding Subsection (a) and except as provided
1616 by Subsection (c-1), if the amount of a state prosecutor's total
1717 annual salary from state and county sources exceeds the amount of
1818 the maximum combined base salary from all state and county sources
1919 provided by Section 659.012 for a district judge with comparable
2020 years of service as the state prosecutor, the comptroller shall
2121 reduce the state prosecutor's state annual salary by the amount
2222 equal to the excess amount, except that the comptroller may not
2323 reduce the state prosecutor's state annual salary to an amount that
2424 is less than the state base salary paid to a district judge as set by
2525 the General Appropriations Act in accordance with Section
2626 659.012(a).
2727 (c-1) The limitation on the amount of a state prosecutor's
2828 total annual salary under Subsection (c) does not apply to the
2929 salary paid to a state prosecutor who serves in a judicial district
3030 or county, as applicable, with a population of less than 400,000.
3131 SECTION 2. This Act takes effect September 1, 2025.
