77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the required number of minutes of instructional time to
1010 be provided by a juvenile justice alternative education program.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 37.011(f), Education Code, is amended to
1313 read as follows:
1414 (f) A juvenile justice alternative education program must
1515 provide [operate] at least 43,200 minutes of instructional time
1616 [seven hours per day and 180 days] per year, except that a program
1717 may apply to the Texas Juvenile Justice Department for a waiver of
1818 the instructional time [180-day] requirement. The department may
1919 not grant a waiver to a program under this subsection for a number
2020 of minutes [days] that exceeds the highest number of instructional
2121 minutes [days] waived by the commissioner during the same school
2222 year for any [a] school district served by the program.
2323 SECTION 2. This Act applies beginning with the 2025-2026
2424 school year.
2525 SECTION 3. This Act takes effect immediately if it receives
2626 a vote of two-thirds of all the members elected to each house, as
2727 provided by Section 39, Article III, Texas Constitution. If this
2828 Act does not receive the vote necessary for immediate effect, this
2929 Act takes effect September 1, 2025.
