11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 37.011(f), Education Code, is amended to | |
13 | 13 | read as follows: | |
14 | 14 | (f) A juvenile justice alternative education program must | |
15 | 15 | provide [operate] at least 43,200 minutes of instructional time | |
16 | 16 | [seven hours per day and 180 days] per year, except that a program | |
17 | 17 | may apply to the Texas Juvenile Justice Department for a waiver of | |
18 | 18 | the instructional time [180-day] requirement. The department may | |
19 | 19 | not grant a waiver to a program under this subsection for a number | |
20 | 20 | of minutes [days] that exceeds the highest number of instructional | |
21 | 21 | minutes [days] waived by the commissioner during the same school | |
22 | 22 | year for any [a] school district served by the program. | |
23 | 23 | SECTION 2. This Act applies beginning with the 2025-2026 | |
24 | 24 | school year. | |
25 | 25 | SECTION 3. This Act takes effect immediately if it receives | |
26 | 26 | a vote of two-thirds of all the members elected to each house, as | |
27 | 27 | provided by Section 39, Article III, Texas Constitution. If this | |
28 | 28 | Act does not receive the vote necessary for immediate effect, this | |
29 | 29 | Act takes effect September 1, 2025. |
