77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the criminal offense of passing certain vehicles on a
1010 highway.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 545.157(a), Transportation Code, is
1313 amended to read as follows:
1414 (a) This section applies only to the following vehicles:
1515 (1) a stationary authorized emergency vehicle using
1616 visual signals that meet the requirements of Sections 547.305 and
1717 547.702;
1818 (2) a stationary tow truck using equipment authorized
1919 by Section 547.305(d);
2020 (3) a Texas Department of Transportation vehicle or a
2121 highway maintenance or construction vehicle operated pursuant to a
2222 contract awarded under Subchapter A, Chapter 223, not separated
2323 from the roadway by a traffic control channelizing device and using
2424 visual signals that comply with the standards and specifications
2525 adopted under Section 547.105;
2626 (4) a service vehicle used by or for a utility, as
2727 defined by Section 203.091, and using visual signals that comply
2828 with the standards and specifications adopted under Section
2929 547.105;
3030 (5) a stationary vehicle used exclusively to transport
3131 municipal solid waste, as defined by Section 361.003, Health and
3232 Safety Code, or recyclable material, as defined by Section 361.421,
3333 Health and Safety Code, while being operated in connection with the
3434 removal or transportation of municipal solid waste or recyclable
3535 material from a location adjacent to the highway; [and]
3636 (6) a vehicle operated by or pursuant to a contract
3737 with a toll project entity, as defined by Section 372.001, using
3838 visual signals that comply with the standards and specifications
3939 adopted under Section 547.105;
4040 (7) a vehicle operated by an animal control officer,
4141 as defined by Section 829.001, Health and Safety Code, for the
4242 purpose of removing an animal or animal carcass from a roadway, or
4343 an individual authorized to dispose of a carcass of an animal under
4444 Section 361.117, Health and Safety Code, for the purpose of
4545 removing an animal carcass from a roadway, and using visual signals
4646 that comply with the standards and specifications adopted under
4747 Section 547.105; and
4848 (8) a vehicle operated by an employee of a local
4949 authority for the purpose of issuing a parking citation and using
5050 visual signals that comply with the standards and specifications
5151 adopted under Section 547.105.
5252 SECTION 2. This Act takes effect September 1, 2025.
