| 9 | 9 | | relating to the criminal offense of passing certain vehicles on a |

| 10 | 10 | | highway. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 545.157(a), Transportation Code, is |
|---|
| 13 | 13 | | amended to read as follows: |
|---|
| 14 | 14 | | (a) This section applies only to the following vehicles: |
|---|
| 15 | 15 | | (1) a stationary authorized emergency vehicle using |
|---|
| 16 | 16 | | visual signals that meet the requirements of Sections 547.305 and |
|---|
| 17 | 17 | | 547.702; |
|---|
| 18 | 18 | | (2) a stationary tow truck using equipment authorized |
|---|
| 19 | 19 | | by Section 547.305(d); |
|---|
| 20 | 20 | | (3) a Texas Department of Transportation vehicle or a |
|---|
| 21 | 21 | | highway maintenance or construction vehicle operated pursuant to a |
|---|
| 22 | 22 | | contract awarded under Subchapter A, Chapter 223, not separated |
|---|
| 23 | 23 | | from the roadway by a traffic control channelizing device and using |
|---|
| 24 | 24 | | visual signals that comply with the standards and specifications |
|---|
| 25 | 25 | | adopted under Section 547.105; |
|---|
| 26 | 26 | | (4) a service vehicle used by or for a utility, as |
|---|
| 27 | 27 | | defined by Section 203.091, and using visual signals that comply |
|---|
| 28 | 28 | | with the standards and specifications adopted under Section |
|---|
| 29 | 29 | | 547.105; |
|---|
| 30 | 30 | | (5) a stationary vehicle used exclusively to transport |
|---|
| 31 | 31 | | municipal solid waste, as defined by Section 361.003, Health and |
|---|
| 32 | 32 | | Safety Code, or recyclable material, as defined by Section 361.421, |
|---|
| 33 | 33 | | Health and Safety Code, while being operated in connection with the |
|---|
| 34 | 34 | | removal or transportation of municipal solid waste or recyclable |
|---|
| 35 | 35 | | material from a location adjacent to the highway; [and] |
|---|
| 36 | 36 | | (6) a vehicle operated by or pursuant to a contract |
|---|
| 37 | 37 | | with a toll project entity, as defined by Section 372.001, using |
|---|
| 38 | 38 | | visual signals that comply with the standards and specifications |
|---|
| 39 | 39 | | adopted under Section 547.105; |
|---|
| 40 | 40 | | (7) a vehicle operated by an animal control officer, |
|---|
| 41 | 41 | | as defined by Section 829.001, Health and Safety Code, for the |
|---|
| 42 | 42 | | purpose of removing an animal or animal carcass from a roadway, or |
|---|
| 43 | 43 | | an individual authorized to dispose of a carcass of an animal under |
|---|
| 44 | 44 | | Section 361.117, Health and Safety Code, for the purpose of |
|---|
| 45 | 45 | | removing an animal carcass from a roadway, and using visual signals |
|---|
| 46 | 46 | | that comply with the standards and specifications adopted under |
|---|
| 47 | 47 | | Section 547.105; and |
|---|
| 48 | 48 | | (8) a vehicle operated by an employee of a local |
|---|
| 49 | 49 | | authority for the purpose of issuing a parking citation and using |
|---|
| 50 | 50 | | visual signals that comply with the standards and specifications |
|---|
| 51 | 51 | | adopted under Section 547.105. |
|---|
| 52 | 52 | | SECTION 2. This Act takes effect September 1, 2025. |
