88 AN ACT
99 relating to the eligibility for grants for alternative fueling
1010 facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 393.004(b), Health and Safety Code, is
1313 amended to read as follows:
1414 (b) Except as otherwise provided by this subsection, the
1515 [The] prioritization criteria established under Subsection (a)
1616 must provide that, for each grant round, the commission may not
1717 award a grant to an entity that does not agree to make the
1818 alternative fueling facility accessible and available to the public
1919 at times designated by the grant contract until each eligible
2020 entity that does agree to those terms has been awarded a grant. The
2121 prohibition imposed by this subsection does not apply to a facility
2222 that is:
2323 (1) owned or operated by a transit authority governed
2424 by Chapter 451 or 452, Transportation Code;
2525 (2) located in a county that has a population of more
2626 than one million; and
2727 (3) located in a nonattainment area or an affected
2828 county, as those terms are defined by Section 386.001.
2929 SECTION 2. The change in law made by this Act applies only
3030 to a grant round that begins on or after the effective date of this
3131 Act. A grant round that began before the effective date of this Act
3232 is governed by the law in effect on the date the grant round began,
3333 and the former law is continued in effect for that purpose.
3434 SECTION 3. This Act takes effect September 1, 2025.
