77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to increasing the minimum term of imprisonment for the
1010 offense of trafficking of persons.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 20A.02(b), Penal Code, as amended by
1313 Chapters 93 (S.B. 1527) and 452 (H.B. 3554), Acts of the 88th
1414 Legislature, Regular Session, 2023, is reenacted and amended to
1515 read as follows:
1616 (b) Except as otherwise provided by this subsection and
1717 Subsection (b-1), an offense under this section is a felony of the
1818 second degree with a minimum term of imprisonment of 15 years. An
1919 offense under this section is a felony of the first degree with a
2020 minimum term of imprisonment of 15 years if:
2121 (1) the applicable conduct constitutes an offense
2222 under Subsection (a)(5), (6), (7), or (8), regardless of whether
2323 the actor knows the age of the child or whether the actor knows the
2424 victim is disabled at the time of the offense;
2525 (2) the commission of the offense results in serious
2626 bodily injury to or the death of the person who is trafficked; [or]
2727 (3) the commission of the offense results in the death
2828 of an unborn child of the person who is trafficked; or
2929 (4) the actor:
3030 (A) used or exhibited a deadly weapon during the
3131 commission of the offense; or
3232 (B) intentionally, knowingly, or recklessly
3333 impeded the normal breathing or circulation of the blood of the
3434 trafficked person by applying pressure to the person's throat or
3535 neck or by blocking the person's nose or mouth.
3636 SECTION 2. Section 20A.02(b-1), Penal Code, as amended by
3737 Chapters 451 (H.B. 3553) and 452 (H.B. 3554), Acts of the 88th
3838 Legislature, Regular Session, 2023, is reenacted and amended to
3939 read as follows:
4040 (b-1) An offense under this section is a felony of the first
4141 degree punishable by imprisonment in the Texas Department of
4242 Criminal Justice for life or for a term of not more than 99 years or
4343 less than 25 years if it is shown on the trial of the offense that
4444 the actor committed the offense in a location that was:
4545 (1) on the premises of or within 1,000 feet of the
4646 premises of:
4747 (A) a school; [or]
4848 (B) an institution of higher education or private
4949 or independent institution of higher education, as defined by
5050 Section 61.003, Education Code;
5151 (C) [(B)] a juvenile detention facility;
5252 (D) [(C)] a post-adjudication secure
5353 correctional facility;
5454 (E) [(D)] a shelter or facility operating as a
5555 residential treatment center that serves runaway youth, foster
5656 children, people who are homeless, or persons subjected to human
5757 trafficking, domestic violence, or sexual assault;
5858 (F) [(E)] a community center offering youth
5959 services and programs; or
6060 (G) [(F)] a child-care facility, as defined by
6161 Section 42.002, Human Resources Code; or
6262 (2) on the premises where or within 1,000 feet of the
6363 premises where:
6464 (A) an official school function was taking place;
6565 or
6666 (B) an event sponsored or sanctioned by the
6767 University Interscholastic League was taking place.
6868 SECTION 3. The change in law made by this Act applies only
6969 to an offense committed on or after the effective date of this Act.
7070 An offense committed before the effective date of this Act is
7171 governed by the law in effect on the date the offense was committed,
7272 and the former law is continued in effect for that purpose. For
7373 purposes of this section, an offense was committed before the
7474 effective date of this Act if any element of the offense occurred
7575 before that date.
7676 SECTION 4. This Act takes effect September 1, 2025.
