88 AN ACT
99 relating to a Texas Education Agency database of school district
1010 bonds, taxes, and bond-related projects.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E, Chapter 45, Education Code, is
1313 amended by adding Section 45.114 to read as follows:
1414 Sec. 45.114. BOND, TAX, AND PROJECT DATABASE. (a) In this
1515 section:
1616 (1) "Bond" means a bond described by Section 45.001.
1717 (2) "Database" means the database established under
1818 this section.
1919 (3) "Maintenance tax" means a tax described by Section
2020 45.002.
2121 (b) The agency shall develop and maintain a database that
2222 includes current information regarding school district bonds,
2323 taxes, and bond-related projects, including:
2424 (1) for each bond issued or proposed by a school
2525 district:
2626 (A) the language of the ballot proposition under
2727 Section 45.003(b);
2828 (B) the projected interest and sinking fund tax
2929 rate associated with a proposed bond;
3030 (C) the result of an election held for the
3131 purpose of issuing a proposed bond;
3232 (D) a list of the projects to be funded using the
3333 bond;
3434 (E) an accounting of the use of the proceeds of
3535 any issued bond, including descriptions of any projects paid for
3636 with the proceeds; and
3737 (F) any increase in the interest and sinking fund
3838 tax rate resulting from issued bonds;
3939 (2) for maintenance taxes that have been levied or
4040 proposed by a school district:
4141 (A) each school district's proposed or approved
4242 tax rate; and
4343 (B) the language of the ballot proposition under
4444 Section 45.003(d);
4545 (3) the results of any election held under Section
4646 26.08, Tax Code, including the ad valorem tax rate proposed by the
4747 school district for purposes of the election;
4848 (4) a report generation function to allow the agency
4949 to generate reports of the information described by Subdivisions
5050 (1) and (2) for each school district, disaggregated by geographic
5151 area; and
5252 (5) a function that allows for the proposal of updates
5353 or corrections to the information included in the database.
5454 (c) A school district shall provide the agency with the
5555 information described by Subsections (b)(1) through (3) and any
5656 other information requested by the agency for the purpose of
5757 maintaining the database established under this section.
5858 (d) The agency may contract with a third party as necessary
5959 for the development or maintenance of the database under this
6060 section.
6161 (e) The commissioner may adopt rules as necessary to
6262 implement this section.
6363 SECTION 2. This Act takes effect September 1, 2025.
