77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the designation of a public school health officer and
1010 the school health and safety allotment under the Foundation School
1111 Program.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subchapter A, Chapter 38, Education Code, is
1414 amended by adding Section 38.047 to read as follows:
1515 Sec. 38.047. SCHOOL HEALTH OFFICER. (a) The principal of
1616 each school district campus shall designate an employee of the
1717 campus as the campus's school health officer.
1818 (b) The school health officer at a school district campus
1919 may:
2020 (1) manage and monitor school health initiatives and
2121 the implementation of health requirements at the campus; and
2222 (2) notwithstanding Section 22.052, administer
2323 medication to students enrolled at the campus in compliance with
2424 the rules adopted under Subsection (c) and other law.
2525 (c) Notwithstanding any other law, the executive
2626 commissioner of the Health and Human Services Commission shall
2727 adopt rules regarding the administration of medication to a student
2828 by a school health officer under this section, including rules
2929 providing a list of medications that a school health officer may
3030 administer.
3131 SECTION 2. The heading to Section 48.115, Education Code,
3232 is amended to read as follows:
3333 Sec. 48.115. SCHOOL HEALTH AND SAFETY ALLOTMENT.
3434 SECTION 3. Section 48.115(b), Education Code, is amended to
3535 read as follows:
3636 (b) Funds allocated under this section must be used to
3737 improve school district student health and school safety and
3838 security, including costs associated with:
3939 (1) securing school facilities in accordance with the
4040 requirements of Section 37.351, including:
4141 (A) improvements to school infrastructure;
4242 (B) the use or installation of perimeter security
4343 fencing conducive to a public school learning environment or
4444 physical barriers, which may not include razor wire;
4545 (C) exterior door and window safety and security
4646 upgrades, including exterior door numbering and locking systems and
4747 security film that provides resistance to a forced entry; and
4848 (D) the purchase and maintenance of:
4949 (i) security cameras and, if the district
5050 has already installed security cameras, other security equipment,
5151 including video surveillance as provided by Section 29.022; and
5252 (ii) technology, including communications
5353 systems or devices, such as silent panic alert devices, two-way
5454 radios, or wireless Internet booster equipment, that facilitates
5555 communication and information sharing between students, school
5656 personnel, and first responders in an emergency;
5757 (2) providing security for the district, including:
5858 (A) employing school district peace officers,
5959 private security officers, and school marshals; and
6060 (B) collaborating with local law enforcement
6161 agencies, such as entering into a memorandum of understanding for
6262 the assignment of school resource officers to schools in the
6363 district;
6464 (3) school safety and security measures, including:
6565 (A) active shooter and emergency response
6666 training;
6767 (B) prevention and treatment programs relating
6868 to addressing adverse childhood experiences; and
6969 (C) the prevention, identification, and
7070 management of emergencies and threats, using evidence-based,
7171 effective prevention practices and including:
7272 (i) providing licensed counselors, social
7373 workers, chaplains, and individuals trained in restorative
7474 discipline and restorative justice practices;
7575 (ii) providing mental health personnel and
7676 support, including chaplains;
7777 (iii) providing behavioral health
7878 services, including services provided by chaplains;
7979 (iv) establishing threat reporting
8080 systems; and
8181 (v) developing and implementing programs
8282 focused on restorative justice practices, culturally relevant
8383 instruction, and providing mental health support, including
8484 support provided by chaplains;
8585 (4) providing programs related to suicide prevention,
8686 intervention, and postvention, including programs provided by
8787 chaplains; [and]
8888 (5) employing a school safety director and other
8989 personnel to manage and monitor school safety initiatives and the
9090 implementation of school safety requirements for the district; and
9191 (6) providing school health officers for each district
9292 campus as required by Section 38.047.
9393 SECTION 4. Section 37.108(b-1), Education Code, is amended
9494 to read as follows:
9595 (b-1) In a school district's safety and security audit
9696 required under Subsection (b), the district must certify that the
9797 district used the funds provided to the district through the school
9898 health and safety allotment under Section 48.115 only for the
9999 purposes provided by that section.
100100 SECTION 5. Section 37.117(c), Education Code, as added by
101101 Chapter 1 (S.B. 838), Acts of the 88th Legislature, Regular
102102 Session, 2023, is amended to read as follows:
103103 (c) To comply with this section, a school district or
104104 open-enrollment charter school may:
105105 (1) use funds provided to the district or school
106106 through the school health and safety allotment under Section 48.115
107107 or other available funds; and
108108 (2) use the district's or school's customary
109109 procurement process.
110110 SECTION 6. Section 37.354(a), Education Code, is amended to
111111 read as follows:
112112 (a) The commissioner may authorize a school district to use
113113 money provided to the district for the purpose of improving school
114114 safety and security, including the school health and safety
115115 allotment under Section 48.115 or any other funding or grant money
116116 available to the district for that purpose, to comply with the
117117 requirements of this subchapter.
118118 SECTION 7. As soon as practicable after the effective date
119119 of this Act, the executive commissioner of the Health and Human
120120 Services Commission shall adopt the rules regarding the
121121 administration of medication to a student by a school health
122122 officer required by Section 38.047, Education Code, as added by
123123 this Act.
124124 SECTION 8. It is the intent of the 89th Legislature, Regular
125125 Session, 2025, that the amendments made by this Act be harmonized
126126 with another Act of the 89th Legislature, Regular Session, 2025,
127127 relating to nonsubstantive additions to and corrections in enacted
128128 codes.
129129 SECTION 9. This Act takes effect September 1, 2025.
