9 | 9 | | relating to a study on the coverage of certain infants under |
---|
10 | 10 | | Medicaid. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. DEFINITION. In this Act, "commission" means the |
---|
13 | 13 | | Health and Human Services Commission. |
---|
14 | 14 | | SECTION 2. STUDY ON INFANTS ELIGIBLE FOR MEDICAID. The |
---|
15 | 15 | | commission shall conduct a study to assess the commission's |
---|
16 | 16 | | compliance with federal guidelines and requirements on the required |
---|
17 | 17 | | coverage of certain infants under Medicaid. In conducting the |
---|
18 | 18 | | study, the commission shall examine whether or the extent to which |
---|
19 | 19 | | the commission: |
---|
20 | 20 | | (1) provides Medicaid coverage to infants born in this |
---|
21 | 21 | | state whose mother was a Medicaid recipient at the time of the |
---|
22 | 22 | | birth; |
---|
23 | 23 | | (2) requires the submission of a separate application |
---|
24 | 24 | | or eligibility determination for infants born in this state whose |
---|
25 | 25 | | mother was a Medicaid recipient at the time of the birth; |
---|
26 | 26 | | (3) requires by rule or otherwise that an infant born |
---|
27 | 27 | | in this state whose mother was a Medicaid recipient at the time of |
---|
28 | 28 | | the birth reside with the infant's mother to remain eligible for |
---|
29 | 29 | | Medicaid; |
---|
30 | 30 | | (4) allows an infant to receive Medicaid coverage by |
---|
31 | 31 | | using the Medicaid identification number of the infant's mother |
---|
32 | 32 | | from the period between the infant's birth until the infant reaches |
---|
33 | 33 | | one year of age or, if the mother does not have a Medicaid |
---|
34 | 34 | | identification number, provides a separate Medicaid identification |
---|
35 | 35 | | number to an infant; |
---|
36 | 36 | | (5) requires proof of citizenship for an infant to |
---|
37 | 37 | | receive Medicaid coverage before the infant reaches one year of |
---|
38 | 38 | | age; |
---|
39 | 39 | | (6) ensures that an infant remains eligible from the |
---|
40 | 40 | | period between the infant's birth until the infant reaches at least |
---|
41 | 41 | | one year of age, unless the infant dies, is moved outside this |
---|
42 | 42 | | state, or is voluntarily disenrolled from Medicaid; and |
---|
43 | 43 | | (7) conducts a redetermination of eligibility for |
---|
44 | 44 | | infants before they reach one year of age. |
---|
45 | 45 | | SECTION 3. REPORT. Not later than September 1, 2026, the |
---|
46 | 46 | | commission shall prepare and submit to the governor, the lieutenant |
---|
47 | 47 | | governor, the speaker of the house of representatives, and the |
---|
48 | 48 | | legislature a written report that: |
---|
49 | 49 | | (1) summarizes the results of the study conducted |
---|
50 | 50 | | under Section 2 of this Act; and |
---|
51 | 51 | | (2) includes any legislative recommendations based on |
---|
52 | 52 | | the results of the study on how to improve coverage rates and |
---|
53 | 53 | | related requirements for infants eligible for Medicaid. |
---|
54 | 54 | | SECTION 4. EXPIRATION. This Act expires September 1, 2027. |
---|
55 | 55 | | SECTION 5. EFFECTIVE DATE. This Act takes effect September |
---|
56 | 56 | | 1, 2025. |
