77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to a study on the coverage of certain infants under
1010 Medicaid.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. DEFINITION. In this Act, "commission" means the
1313 Health and Human Services Commission.
1414 SECTION 2. STUDY ON INFANTS ELIGIBLE FOR MEDICAID. The
1515 commission shall conduct a study to assess the commission's
1616 compliance with federal guidelines and requirements on the required
1717 coverage of certain infants under Medicaid. In conducting the
1818 study, the commission shall examine whether or the extent to which
1919 the commission:
2020 (1) provides Medicaid coverage to infants born in this
2121 state whose mother was a Medicaid recipient at the time of the
2222 birth;
2323 (2) requires the submission of a separate application
2424 or eligibility determination for infants born in this state whose
2525 mother was a Medicaid recipient at the time of the birth;
2626 (3) requires by rule or otherwise that an infant born
2727 in this state whose mother was a Medicaid recipient at the time of
2828 the birth reside with the infant's mother to remain eligible for
2929 Medicaid;
3030 (4) allows an infant to receive Medicaid coverage by
3131 using the Medicaid identification number of the infant's mother
3232 from the period between the infant's birth until the infant reaches
3333 one year of age or, if the mother does not have a Medicaid
3434 identification number, provides a separate Medicaid identification
3535 number to an infant;
3636 (5) requires proof of citizenship for an infant to
3737 receive Medicaid coverage before the infant reaches one year of
3838 age;
3939 (6) ensures that an infant remains eligible from the
4040 period between the infant's birth until the infant reaches at least
4141 one year of age, unless the infant dies, is moved outside this
4242 state, or is voluntarily disenrolled from Medicaid; and
4343 (7) conducts a redetermination of eligibility for
4444 infants before they reach one year of age.
4545 SECTION 3. REPORT. Not later than September 1, 2026, the
4646 commission shall prepare and submit to the governor, the lieutenant
4747 governor, the speaker of the house of representatives, and the
4848 legislature a written report that:
4949 (1) summarizes the results of the study conducted
5050 under Section 2 of this Act; and
5151 (2) includes any legislative recommendations based on
5252 the results of the study on how to improve coverage rates and
5353 related requirements for infants eligible for Medicaid.
5454 SECTION 4. EXPIRATION. This Act expires September 1, 2027.
5555 SECTION 5. EFFECTIVE DATE. This Act takes effect September
5656 1, 2025.
