| 10 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 13 | | SECTION 1. Article 55A.005, Code of Criminal Procedure, is |

| 12 | 14 | | amended to read as follows: |
|---|
| 13 | 15 | | Art. 55A.005. UNLAWFUL CARRYING OF HANDGUN. A person to |
|---|
| 14 | 16 | | whom this subchapter applies is entitled to have all records and |
|---|
| 15 | 17 | | files relating to the arrest expunged if: |
|---|
| 16 | 18 | | (1) the person was: |
|---|
| 17 | 19 | | (A) tried for and convicted of the offense for |
|---|
| 18 | 20 | | which the person was arrested; or |
|---|
| 19 | 21 | | (B) placed on deferred adjudication community |
|---|
| 20 | 22 | | supervision under Subchapter C, Chapter 42A, for the offense for |
|---|
| 21 | 23 | | which the person was arrested; and |
|---|
| 22 | 24 | | (2) the offense was committed before September 1, |
|---|
| 23 | 25 | | 2021, under Section 46.02(a), Penal Code, as that section existed |
|---|
| 24 | 26 | | before that date. |

| 25 | 27 | | SECTION 2. This Act takes effect September 1, 2025. |
