77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the joint planning of desired future conditions in
1010 groundwater management areas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 36.1071(e), Water Code, is amended to
1313 read as follows:
1414 (e) In the management plan described under Subsection (a),
1515 the district shall:
1616 (1) identify the performance standards and management
1717 objectives under which the district will operate to achieve the
1818 management goals identified under Subsection (a);
1919 (2) specify, in as much detail as possible, the
2020 actions, procedures, performance, and avoidance that are or may be
2121 necessary to effect the plan, including specifications and proposed
2222 rules;
2323 (3) include estimates of the following:
2424 (A) modeled available groundwater in the
2525 district based on the desired future condition established under
2626 Section 36.108;
2727 (B) the amount of groundwater being used within
2828 the district on an annual basis;
2929 (C) the annual amount of recharge from
3030 precipitation, if any, to the groundwater resources within the
3131 district;
3232 (D) for each aquifer, the annual volume of water
3333 that discharges from the aquifer to springs and any surface water
3434 bodies, including lakes, streams, and rivers;
3535 (E) the annual volume of flow into and out of the
3636 district within each aquifer and between aquifers in the district,
3737 if a groundwater availability model is available;
3838 (F) the projected surface water supply in the
3939 district according to the most recently adopted state water plan;
4040 and
4141 (G) the projected total demand for water in the
4242 district according to the most recently adopted state water plan;
4343 [and]
4444 (4) consider the water supply needs and water
4545 management strategies included in the adopted state water plan; and
4646 (5) include an explanation in plain language of how:
4747 (A) the district is monitoring and tracking the
4848 achievement of the desired future conditions established under
4949 Section 36.108; and
5050 (B) the district has performed in achieving the
5151 desired future conditions established under Section 36.108 over the
5252 preceding five-year joint planning period.
5353 SECTION 2. Section 36.108, Water Code, is amended by
5454 amending Subsections (c) and (d-3) and adding Subsections (c-1) and
5555 (d-5) to read as follows:
5656 (c) The district representatives shall meet at least
5757 annually to conduct joint planning with the other districts in the
5858 management area. The representatives shall [and to] review:
5959 (1) [the management plans,] the accomplishments of the
6060 management area;
6161 (2) [, and] proposals to adopt new or amend existing
6262 desired future conditions; and
6363 (3) not less than once during each five-year period
6464 described by Subsection (d), the management plans of each district
6565 in the management area.
6666 (c-1) In reviewing the management plans under Subsection
6767 (c), the districts shall consider:
6868 (1) the goals of each management plan and its impact on
6969 planning throughout the management area;
7070 (2) the effectiveness of the measures established by
7171 each district's management plan for conserving and protecting
7272 groundwater and preventing waste, and the effectiveness of these
7373 measures in the management area generally;
7474 (3) any other matters that the boards consider
7575 relevant to the protection and conservation of groundwater and the
7676 prevention of waste in the management area; and
7777 (4) the degree to which each district is achieving
7878 [management plan achieves] the desired future conditions
7979 established during the joint planning process through the
8080 implementation of the district's management plan and rules.
8181 (d-3) After each district has submitted to the district
8282 representatives the information required under Subsection (d-2)
8383 and made the information available for the required period of time
8484 under Subsection (d-2a), the district representatives shall
8585 reconvene for a joint planning meeting to review the information
8686 required under Subsection (d-2), consider any district's suggested
8787 revisions to the proposed desired future conditions, receive public
8888 comment, and finally adopt the desired future conditions for the
8989 management area. The desired future conditions must be approved by
9090 a resolution adopted by a two-thirds vote of all the district
9191 representatives not later than January 5, 2022. Subsequent desired
9292 future conditions must be proposed and finally adopted by the
9393 district representatives before the end of each successive
9494 five-year period after that date. The district representatives
9595 shall produce a desired future conditions explanatory report for
9696 the management area and submit to the development board and each
9797 district in the management area proof that notice was posted for the
9898 joint planning meeting, a copy of the resolution, and a copy of the
9999 explanatory report. The report must:
100100 (1) identify each desired future condition;
101101 (2) provide the policy and technical justifications
102102 for each desired future condition;
103103 (3) include documentation that the factors under
104104 Subsection (d) were considered by the districts and a discussion of
105105 how the adopted desired future conditions impact each factor;
106106 (4) list other desired future condition options
107107 considered, if any, and the reasons why those options were not
108108 adopted; [and]
109109 (5) discuss reasons why recommendations made by
110110 advisory committees and relevant public comments received by the
111111 districts during the public comment period or at the joint planning
112112 meeting were or were not incorporated into the desired future
113113 conditions;
114114 (6) include an explanation in plain language of why a
115115 desired future condition adopted for an aquifer was changed if the
116116 desired future condition is different from the desired future
117117 condition adopted for the aquifer over the preceding five-year
118118 joint planning period; and
119119 (7) include a summary of how each district is
120120 performing in achieving the desired future conditions.
121121 (d-5) The districts and district representatives:
122122 (1) shall adopt desired future conditions under this
123123 section for each 50-year planning period identified by the
124124 executive administrator for the preparation of state and regional
125125 water plans;
126126 (2) shall identify interim values for the desired
127127 future conditions adopted under Subdivision (1) for time periods
128128 not to exceed 10 years solely to assist the districts in monitoring
129129 interim progress in achieving the desired future conditions adopted
130130 for the 50-year planning period; and
131131 (3) may adopt desired future conditions under this
132132 section for other time periods.
133133 SECTION 3. This Act takes effect immediately if it receives
134134 a vote of two-thirds of all the members elected to each house, as
135135 provided by Section 39, Article III, Texas Constitution. If this
136136 Act does not receive the vote necessary for immediate effect, this
137137 Act takes effect September 1, 2025.
