12 | 12 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
13 | 13 | SECTION 1. Section 499.1215(b), Government Code, is amended | |
14 | 14 | to read as follows: | |
15 | 15 | (b) The department shall take custody of a person awaiting | |
16 | 16 | transfer to the department following conviction of a felony and | |
17 | 17 | sentencing to death or to a term of imprisonment in the department | |
18 | 18 | or confinement in a state jail not later than the first [45th] day | |
19 | 19 | following the date on which all documents required by Sections 8(a) | |
20 | 20 | and (c), Article 42.09, Code of Criminal Procedure, have been | |
21 | 21 | certified as required by Section 8(b) of that article. | |
22 | 22 | SECTION 2. The change in law made by this Act applies only | |
23 | 23 | to the confinement of a person that occurs on or after the effective | |
24 | 24 | date of this Act, regardless of whether the requirements for | |
25 | 25 | transfer of the person to the Texas Department of Criminal Justice | |
26 | 26 | are completed before, on, or after that date. | |
27 | 27 | SECTION 3. This Act takes effect September 1, 2025. |
