77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the regulation by the Texas Commission on Environmental
1010 Quality of certain solid waste processing facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter C, Chapter 361, Health and Safety
1313 Code, is amended by adding Section 361.127 to read as follows:
1414 Sec. 361.127. REQUIREMENTS APPLICABLE TO CERTAIN SOLID
1515 WASTE PROCESSING FACILITIES. (a) This section applies only to a
1616 solid waste processing facility that salvages, separates,
1717 dewaters, reclaims, or otherwise processes municipal sludge,
1818 sewage, septage, grease trap waste, or grit trap waste.
1919 (b) An owner or operator of a solid waste processing
2020 facility must have the consent of and authorization from the owner
2121 or operator of:
2222 (1) the wastewater collection system that will receive
2323 the treated wastewater produced by the processing facility; and
2424 (2) any wastewater treatment facility that will
2525 further treat the treated wastewater.
2626 (c) The commission may not issue, amend, or renew a permit
2727 under this chapter for a solid waste processing facility unless the
2828 owner or operator of the processing facility demonstrates to the
2929 commission's satisfaction that the owner or operator has complied
3030 with Subsection (b).
3131 SECTION 2. Section 361.127(c), Health and Safety Code, as
3232 added by this Act, applies only to a solid waste processing facility
3333 the owner or operator of which files an application with the Texas
3434 Commission on Environmental Quality for the issuance, amendment, or
3535 renewal of a permit on or after the effective date of this Act. A
3636 solid waste processing facility the owner or operator of which
3737 filed an application with the commission for the issuance,
3838 amendment, or renewal of a permit before the effective date of this
3939 Act is governed by the law as it existed immediately before the
4040 effective date of this Act, and that law is continued in effect for
4141 that purpose.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect September 1, 2025.
