88 AN ACT
99 relating to cardiopulmonary resuscitation certification
1010 requirements for certain food service establishment employees.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Chapter 438, Health and Safety Code, is amended
1313 by adding Subchapter E to read as follows:
1414 SUBCHAPTER E. CARDIOPULMONARY RESUSCITATION CERTIFICATION FOR
1515 CERTAIN FOOD SERVICE EMPLOYEES
1616 Sec. 438.051. DEFINITION. In this subchapter, "food
1717 service establishment" has the meaning assigned by Section 437.001.
1818 Sec. 438.052. APPLICABILITY. This subchapter applies only
1919 to a food service establishment with a space designed for food
2020 consumption on the premises of the establishment.
2121 Sec. 438.053. CARDIOPULMONARY RESUSCITATION CERTIFICATION.
2222 A food service establishment may require each establishment
2323 employee whose position requires regular interaction with
2424 customers consuming food on the establishment's premises to hold a
2525 certification in cardiopulmonary resuscitation issued by the
2626 American Heart Association, the American Red Cross, or a similar
2727 nationally recognized association. The establishment is not
2828 required to reimburse an employee for the cost of obtaining the
2929 certification.
3030 Sec. 438.054. CIVIL LIABILITY. (a) A food service
3131 establishment or an owner, employee, or agent of a food service
3232 establishment is not liable for civil damages resulting from the
3333 use of, attempted use of, or failure to use cardiopulmonary
3434 resuscitation unless the use of, attempted use of, or failure to use
3535 cardiopulmonary resuscitation is intentional or wilfully or
3636 wantonly negligent.
3737 (b) The immunity provided by this section is in addition to
3838 any other immunity provided by law.
3939 (c) Whether a person described by Subsection (a) holds a
4040 certification in or has received training in cardiopulmonary
4141 resuscitation does not affect the person's immunity from liability
4242 under this section.
4343 SECTION 2. This Act takes effect September 1, 2025.
