77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the prosecution of the criminal offense of reckless
1010 discharge of a firearm in certain municipalities and counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. The heading to Section 42.12, Penal Code, is
1313 amended to read as follows:
1414 Sec. 42.12. RECKLESS DISCHARGE OF FIREARM IN CERTAIN
1515 MUNICIPALITIES AND COUNTIES.
1616 SECTION 2. Sections 42.12(a) and (d), Penal Code, are
1717 amended to read as follows:
1818 (a) A person commits an offense if the person recklessly
1919 discharges a firearm:
2020 (1) inside the corporate limits of a municipality
2121 having a population of 100,000 or more; or
2222 (2) in a county with a population of 500,000 or more.
2323 (d) Subsection (a) does not affect the authority of a county
2424 or municipality under other law to enact an order or ordinance which
2525 prohibits the discharge of a firearm.
2626 SECTION 3. The change in law made by this Act applies only
2727 to an offense committed on or after the effective date of this Act.
2828 An offense committed before the effective date of this Act is
2929 governed by the law in effect on the date the offense was committed,
3030 and the former law is continued in effect for that purpose. For
3131 purposes of this section, an offense was committed before the
3232 effective date of this Act if any element of the offense occurred
3333 before that date.
3434 SECTION 4. This Act takes effect September 1, 2025.
