11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. STUDY ON UNREPORTED GUNSHOTS. (a) In this Act, |
---|
13 | 13 | | "department" means the Department of Public Safety of the State of |
---|
14 | 14 | | Texas. |
---|
15 | 15 | | (b) From money appropriated or otherwise available for the |
---|
16 | 16 | | purpose, the department shall contract with three eligible |
---|
17 | 17 | | municipal police departments to conduct a study on unreported |
---|
18 | 18 | | gunshots detected using gunshot detection technology. The study |
---|
19 | 19 | | must include the following information: |
---|
20 | 20 | | (1) the number of unreported gunshots detected using |
---|
21 | 21 | | gunshot detection technology that occur within the boundaries of |
---|
22 | 22 | | the municipality; and |
---|
23 | 23 | | (2) for each gunshot described by Subdivision (1) of |
---|
24 | 24 | | this subsection: |
---|
25 | 25 | | (A) the results of any police department |
---|
26 | 26 | | investigation related to the gunshot, including information |
---|
27 | 27 | | regarding whether the gunshot was intentional; and |
---|
28 | 28 | | (B) the number and type of criminal charges filed |
---|
29 | 29 | | as a result of the gunshot. |
---|
30 | 30 | | (c) To be eligible to receive a contract under Subsection |
---|
31 | 31 | | (b) of this section, a municipal police department must: |
---|
32 | 32 | | (1) be located in a municipality with a population of |
---|
33 | 33 | | more than 500,000; and |
---|
34 | 34 | | (2) submit an application to the department that |
---|
35 | 35 | | includes: |
---|
36 | 36 | | (A) a list of geographic areas within the |
---|
37 | 37 | | boundaries of the municipality that have been identified as having |
---|
38 | 38 | | high rates of unreported gunshots; |
---|
39 | 39 | | (B) an explanation of the police department's |
---|
40 | 40 | | previous experience with gunshot detection technologies; and |
---|
41 | 41 | | (C) the proposed members of a five-person |
---|
42 | 42 | | committee that the police department will establish to assist with |
---|
43 | 43 | | the study if the police department receives the contract, |
---|
44 | 44 | | including: |
---|
45 | 45 | | (i) one representative from the municipal |
---|
46 | 46 | | police department; |
---|
47 | 47 | | (ii) one representative from the sheriff's |
---|
48 | 48 | | department in the county in which the municipal police department |
---|
49 | 49 | | is located; |
---|
50 | 50 | | (iii) one person who serves as a school |
---|
51 | 51 | | district peace officer, a school resource officer, or security |
---|
52 | 52 | | personnel as described by Section 37.081, Education Code, and who |
---|
53 | 53 | | provides security at a school campus located in the municipality |
---|
54 | 54 | | described by Subdivision (1) of this subsection; |
---|
55 | 55 | | (iv) one representative of a neighborhood |
---|
56 | 56 | | association located in the municipality described by Subdivision |
---|
57 | 57 | | (1) of this subsection; and |
---|
58 | 58 | | (v) one member who is appointed by a member |
---|
59 | 59 | | of the house of representatives whose district contains any part of |
---|
60 | 60 | | the municipality described by Subdivision (1) of this subsection. |
---|
61 | 61 | | (d) Each municipal police department that the department |
---|
62 | 62 | | contracts with under Subsection (b) of this section shall prepare |
---|
63 | 63 | | and submit a report of its findings to the department not later than |
---|
64 | 64 | | September 1, 2026. |
---|
65 | 65 | | (e) Not later than December 31, 2026, the department shall |
---|
66 | 66 | | prepare and submit to the legislature a written report summarizing |
---|
67 | 67 | | the results of the study, disaggregated by municipality. |
---|
68 | 68 | | (f) This Act expires September 1, 2027. |
---|
69 | 69 | | SECTION 2. EFFECTIVE DATE. This Act takes effect September |
---|
70 | 70 | | 1, 2025. |
