77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of an advisory committee to study and
1010 provide recommendations to state agencies on ways to increase
1111 efficiency at the agencies.
1212 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1313 SECTION 1. Subtitle C, Title 10, Government Code, is
1414 amended by adding Chapter 2117 to read as follows:
1515 CHAPTER 2117. TEXAS DEPARTMENT OF GOVERNMENT EFFICIENCY
1616 Sec. 2117.001. ESTABLISHMENT AND NAME OF ADVISORY
1717 COMMITTEE. (a) An advisory committee is established to study and
1818 make recommendations to each state agency in the executive branch
1919 of state government on ways to increase the efficiency with which
2020 the agency operates.
2121 (b) The advisory committee shall be referred to as the Texas
2222 Department of Government Efficiency.
2323 Sec. 2117.002. COMPOSITION OF ADVISORY COMMITTEE. (a) The
2424 advisory committee is composed of the following eight members:
2525 (1) two members appointed by the governor;
2626 (2) two members appointed by the lieutenant governor;
2727 (3) two members appointed by the speaker of the house
2828 of representatives;
2929 (4) the chair of the senate committee on finance; and
3030 (5) the chair of the house committee on
3131 appropriations.
3232 (b) In making appointments to the advisory committee under
3333 Subsection (a):
3434 (1) the governor may:
3535 (A) appoint two public members to the committee;
3636 or
3737 (B) appoint one public member to the committee
3838 and elect to serve as a member of the committee;
3939 (2) the lieutenant governor may:
4040 (A) appoint two public members to the committee;
4141 or
4242 (B) appoint one public member to the committee
4343 and:
4444 (i) elect to serve as a member of the
4545 committee; or
4646 (ii) appoint a member of the senate to the
4747 committee; and
4848 (3) the speaker of the house of representatives may:
4949 (A) appoint two public members to the committee;
5050 or
5151 (B) appoint one public member to the committee
5252 and:
5353 (i) elect to serve as a member of the
5454 committee; or
5555 (ii) appoint another member of the house of
5656 representatives to the committee.
5757 Sec. 2117.003. TERMS; VACANCY. (a) Members of the advisory
5858 committee serve two-year terms.
5959 (b) A vacancy on the advisory committee shall be filled in
6060 the same manner as the original appointment. A member appointed to
6161 fill a vacancy on the committee shall serve for the remainder of the
6262 unexpired term.
6363 Sec. 2117.004. PRESIDING OFFICER. (a) If the governor
6464 serves as a member of the advisory committee, the governor is the
6565 presiding officer of the committee.
6666 (b) If the governor is not a member of the advisory
6767 committee, the governor shall appoint one member of the committee
6868 to serve as the committee's presiding officer.
6969 (c) The presiding officer of the advisory committee serves a
7070 two-year term.
7171 Sec. 2117.005. MEETINGS. The advisory committee shall meet
7272 at the call of the committee's presiding officer.
7373 Sec. 2117.006. REIMBURSEMENT FOR EXPENSES. Members of the
7474 advisory committee serve without compensation but are entitled to
7575 reimbursement for actual and necessary expenses incurred in
7676 performing official duties under this chapter.
7777 Sec. 2117.007. PURPOSE OF ADVISORY COMMITTEE. The advisory
7878 committee is established to:
7979 (1) study the operation of each state agency in
8080 accordance with a schedule adopted by the committee to identify
8181 ways to increase the efficiency with which the agency operates;
8282 (2) recommend to each state agency that is the subject
8383 of a study described by Subdivision (1) ways of increasing the
8484 agency's operational efficiency identified by the committee during
8585 the study; and
8686 (3) prepare and submit the report required by Section
8787 2117.008.
8888 Sec. 2117.008. ADVISORY COMMITTEE REPORT. Not later than
8989 December 1 of each even-numbered year, the advisory committee shall
9090 prepare and submit to the governor, the lieutenant governor, and
9191 each member of the legislature a report that includes:
9292 (1) the name of each state agency studied by the
9393 committee under Section 2117.007(1) during the two-year period
9494 preceding the date of the report and the recommendations made to
9595 each of those agencies under Section 2117.007(2); and
9696 (2) any proposed legislation prepared by the committee
9797 related to the information described by Subdivision (1) or any
9898 other matter the committee determines is relevant to the efficient
9999 operation of state agencies.
100100 Sec. 2117.009. APPLICATION OF OTHER LAW. Chapter 2110 does
101101 not apply to the advisory committee.
102102 SECTION 2. This Act takes effect immediately if it receives
103103 a vote of two-thirds of all the members elected to each house, as
104104 provided by Section 39, Article III, Texas Constitution. If this
105105 Act does not receive the vote necessary for immediate effect, this
106106 Act takes effect September 1, 2025.
