11 | 11 | | efficiency at the agencies. |

12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

13 | 13 | | SECTION 1. Subtitle C, Title 10, Government Code, is |
---|
14 | 14 | | amended by adding Chapter 2117 to read as follows: |
---|
15 | 15 | | CHAPTER 2117. TEXAS DEPARTMENT OF GOVERNMENT EFFICIENCY |
---|
16 | 16 | | Sec. 2117.001. ESTABLISHMENT AND NAME OF ADVISORY |
---|
17 | 17 | | COMMITTEE. (a) An advisory committee is established to study and |
---|
18 | 18 | | make recommendations to each state agency in the executive branch |
---|
19 | 19 | | of state government on ways to increase the efficiency with which |
---|
20 | 20 | | the agency operates. |
---|
21 | 21 | | (b) The advisory committee shall be referred to as the Texas |
---|
22 | 22 | | Department of Government Efficiency. |
---|
23 | 23 | | Sec. 2117.002. COMPOSITION OF ADVISORY COMMITTEE. (a) The |
---|
24 | 24 | | advisory committee is composed of the following eight members: |
---|
25 | 25 | | (1) two members appointed by the governor; |
---|
26 | 26 | | (2) two members appointed by the lieutenant governor; |
---|
27 | 27 | | (3) two members appointed by the speaker of the house |
---|
28 | 28 | | of representatives; |
---|
29 | 29 | | (4) the chair of the senate committee on finance; and |
---|
30 | 30 | | (5) the chair of the house committee on |
---|
31 | 31 | | appropriations. |
---|
32 | 32 | | (b) In making appointments to the advisory committee under |
---|
33 | 33 | | Subsection (a): |
---|
34 | 34 | | (1) the governor may: |
---|
35 | 35 | | (A) appoint two public members to the committee; |
---|
36 | 36 | | or |
---|
37 | 37 | | (B) appoint one public member to the committee |
---|
38 | 38 | | and elect to serve as a member of the committee; |
---|
39 | 39 | | (2) the lieutenant governor may: |
---|
40 | 40 | | (A) appoint two public members to the committee; |
---|
41 | 41 | | or |
---|
42 | 42 | | (B) appoint one public member to the committee |
---|
43 | 43 | | and: |
---|
44 | 44 | | (i) elect to serve as a member of the |
---|
45 | 45 | | committee; or |
---|
46 | 46 | | (ii) appoint a member of the senate to the |
---|
47 | 47 | | committee; and |
---|
48 | 48 | | (3) the speaker of the house of representatives may: |
---|
49 | 49 | | (A) appoint two public members to the committee; |
---|
50 | 50 | | or |
---|
51 | 51 | | (B) appoint one public member to the committee |
---|
52 | 52 | | and: |
---|
53 | 53 | | (i) elect to serve as a member of the |
---|
54 | 54 | | committee; or |
---|
55 | 55 | | (ii) appoint another member of the house of |
---|
56 | 56 | | representatives to the committee. |
---|
57 | 57 | | Sec. 2117.003. TERMS; VACANCY. (a) Members of the advisory |
---|
58 | 58 | | committee serve two-year terms. |
---|
59 | 59 | | (b) A vacancy on the advisory committee shall be filled in |
---|
60 | 60 | | the same manner as the original appointment. A member appointed to |
---|
61 | 61 | | fill a vacancy on the committee shall serve for the remainder of the |
---|
62 | 62 | | unexpired term. |
---|
63 | 63 | | Sec. 2117.004. PRESIDING OFFICER. (a) If the governor |
---|
64 | 64 | | serves as a member of the advisory committee, the governor is the |
---|
65 | 65 | | presiding officer of the committee. |
---|
66 | 66 | | (b) If the governor is not a member of the advisory |
---|
67 | 67 | | committee, the governor shall appoint one member of the committee |
---|
68 | 68 | | to serve as the committee's presiding officer. |
---|
69 | 69 | | (c) The presiding officer of the advisory committee serves a |
---|
70 | 70 | | two-year term. |
---|
71 | 71 | | Sec. 2117.005. MEETINGS. The advisory committee shall meet |
---|
72 | 72 | | at the call of the committee's presiding officer. |
---|
73 | 73 | | Sec. 2117.006. REIMBURSEMENT FOR EXPENSES. Members of the |
---|
74 | 74 | | advisory committee serve without compensation but are entitled to |
---|
75 | 75 | | reimbursement for actual and necessary expenses incurred in |
---|
76 | 76 | | performing official duties under this chapter. |
---|
77 | 77 | | Sec. 2117.007. PURPOSE OF ADVISORY COMMITTEE. The advisory |
---|
78 | 78 | | committee is established to: |
---|
79 | 79 | | (1) study the operation of each state agency in |
---|
80 | 80 | | accordance with a schedule adopted by the committee to identify |
---|
81 | 81 | | ways to increase the efficiency with which the agency operates; |
---|
82 | 82 | | (2) recommend to each state agency that is the subject |
---|
83 | 83 | | of a study described by Subdivision (1) ways of increasing the |
---|
84 | 84 | | agency's operational efficiency identified by the committee during |
---|
85 | 85 | | the study; and |
---|
86 | 86 | | (3) prepare and submit the report required by Section |
---|
87 | 87 | | 2117.008. |
---|
88 | 88 | | Sec. 2117.008. ADVISORY COMMITTEE REPORT. Not later than |
---|
89 | 89 | | December 1 of each even-numbered year, the advisory committee shall |
---|
90 | 90 | | prepare and submit to the governor, the lieutenant governor, and |
---|
91 | 91 | | each member of the legislature a report that includes: |
---|
92 | 92 | | (1) the name of each state agency studied by the |
---|
93 | 93 | | committee under Section 2117.007(1) during the two-year period |
---|
94 | 94 | | preceding the date of the report and the recommendations made to |
---|
95 | 95 | | each of those agencies under Section 2117.007(2); and |
---|
96 | 96 | | (2) any proposed legislation prepared by the committee |
---|
97 | 97 | | related to the information described by Subdivision (1) or any |
---|
98 | 98 | | other matter the committee determines is relevant to the efficient |
---|
99 | 99 | | operation of state agencies. |
---|
100 | 100 | | Sec. 2117.009. APPLICATION OF OTHER LAW. Chapter 2110 does |
---|
101 | 101 | | not apply to the advisory committee. |
---|
102 | 102 | | SECTION 2. This Act takes effect immediately if it receives |
---|
103 | 103 | | a vote of two-thirds of all the members elected to each house, as |
---|
104 | 104 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
105 | 105 | | Act does not receive the vote necessary for immediate effect, this |
---|
106 | 106 | | Act takes effect September 1, 2025. |
