77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the establishment of the Texas Pay Equity Task Force.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) In this section, "task force" means the Texas
1212 Pay Equity Task Force.
1313 (b) The Texas Pay Equity Task Force is established to assess
1414 whether a disparity exists on the basis of gender, disability, or
1515 race in compensation paid to employees of state agencies, counties,
1616 and municipalities.
1717 (c) The task force is composed of nine members appointed as
1818 follows:
1919 (1) two representatives of state agencies and one
2020 representative of a nonprofit organization engaged in gender,
2121 disability, or race pay equity issues, appointed by the governor;
2222 (2) one representative of a county, one representative
2323 of a municipality, and one representative of a nonprofit
2424 organization engaged in gender, disability, or race pay equity
2525 issues, appointed by the lieutenant governor; and
2626 (3) one representative of a county, one representative
2727 of a municipality, and one representative of a nonprofit
2828 organization engaged in gender, disability, or race pay equity
2929 issues, appointed by the speaker of the house of representatives.
3030 (d) A task force member is not entitled to compensation for
3131 service on the task force but is, to the extent money is available,
3232 entitled to reimbursement for actual and necessary expenses
3333 incurred in performing task force duties. The task force may accept
3434 gifts, grants, and donations to pay for those expenses.
3535 (e) The members of the task force shall elect a presiding
3636 officer from among the membership.
3737 (f) The task force shall meet at least quarterly at the call
3838 of the presiding officer.
3939 (g) Notwithstanding Chapter 551, Government Code, or any
4040 other law, the task force may meet by telephone conference call,
4141 videoconference, or other similar telecommunication method. A
4242 meeting held by telephone conference call, videoconference, or
4343 other similar telecommunication method is subject to the
4444 requirements of Sections 551.125(c), (d), (e), and (f), Government
4545 Code.
4646 (h) The task force shall conduct a study to determine
4747 whether a disparity exists on the basis of gender, disability, or
4848 race in compensation paid to employees of state agencies, counties,
4949 and municipalities. The task force may request payroll information,
5050 including the gender, disability status, and race of each employee,
5151 from a state agency, county, or municipality, and the state agency,
5252 county, or municipality shall comply with the request.
5353 (i) If the task force determines that a pay disparity
5454 exists, the task force shall develop recommendations to eliminate
5555 the disparity.
5656 (j) The task force shall develop and submit a written report
5757 on the study and recommendations developed by the task force to the
5858 governor, the lieutenant governor, the speaker of the house of
5959 representatives, and each member of the legislature not later than
6060 November 1, 2026.
6161 (k) The task force is abolished and this Act expires June 1,
6262 2027.
6363 SECTION 2. Not later than the 30th day following the
6464 effective date of this Act, the governor, the lieutenant governor,
6565 and the speaker of the house of representatives shall appoint the
6666 members of the Texas Pay Equity Task Force as established by this
6767 Act.
6868 SECTION 3. This Act takes effect immediately if it receives
6969 a vote of two-thirds of all the members elected to each house, as
7070 provided by Section 39, Article III, Texas Constitution. If this
7171 Act does not receive the vote necessary for immediate effect, this
7272 Act takes effect September 1, 2025.
