9 | 9 | | relating to the rural sheriff's office, rural constable's office, |
---|
10 | 10 | | and rural prosecutor's office salary assistance grant programs. |
---|
11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
12 | 12 | | SECTION 1. Sections 130.911(e) and (h), Local Government |
---|
13 | 13 | | Code, are amended to read as follows: |
---|
14 | 14 | | (e) A county that is awarded a grant shall use or authorize |
---|
15 | 15 | | the use of the grant money only: |
---|
16 | 16 | | (1) to provide a minimum annual salary of at least: |
---|
17 | 17 | | (A) $75,000 for the county sheriff; |
---|
18 | 18 | | (B) $45,000 for each deputy who makes motor |
---|
19 | 19 | | vehicle stops in the routine performance of their duties; [and] |
---|
20 | 20 | | (C) $40,000 for each jailer whose duties include |
---|
21 | 21 | | the safekeeping of prisoners and the security of a jail operated by |
---|
22 | 22 | | the county; and |
---|
23 | 23 | | (D) $40,000 for each telecommunicator, as |
---|
24 | 24 | | defined by Section 1701.001, Occupations Code, employed by the |
---|
25 | 25 | | county sheriff; |
---|
26 | 26 | | (2) to increase the salary of a person described by |
---|
27 | 27 | | Subdivision (1); |
---|
28 | 28 | | (3) to hire additional deputies or staff for the |
---|
29 | 29 | | sheriff's office; or |
---|
30 | 30 | | (4) to purchase vehicles, firearms, and safety |
---|
31 | 31 | | equipment for the sheriff's office. |
---|
32 | 32 | | (h) The comptroller shall adopt rules necessary to |
---|
33 | 33 | | implement this section, including rules that establish: |
---|
34 | 34 | | (1) a standardized application process, including the |
---|
35 | 35 | | form to be used to apply for a grant and the manner of submitting the |
---|
36 | 36 | | form; |
---|
37 | 37 | | (2) deadlines for: |
---|
38 | 38 | | (A) applying for the grant; |
---|
39 | 39 | | (B) disbursement of grant money; and |
---|
40 | 40 | | (C) spending grant money; and |
---|
41 | 41 | | (3) procedures for: |
---|
42 | 42 | | (A) monitoring the disbursement of grant money to |
---|
43 | 43 | | ensure compliance with this section, including a requirement that |
---|
44 | 44 | | the county auditor or other appropriate county officer report to |
---|
45 | 45 | | the comptroller's office on the disbursement and compliance; and |
---|
46 | 46 | | (B) the return of grant money that was not used by |
---|
47 | 47 | | a county for a purpose authorized by this section. |
---|
48 | 48 | | SECTION 2. Sections 130.912(d) and (g), Local Government |
---|
49 | 49 | | Code, are amended to read as follows: |
---|
50 | 50 | | (d) The comptroller shall award a grant to a qualified |
---|
51 | 51 | | county that applies for the grant using money appropriated to the |
---|
52 | 52 | | comptroller for that purpose. The comptroller may only award a |
---|
53 | 53 | | grant to a county if the county agrees in writing to contribute at |
---|
54 | 54 | | least 25 [75] percent of the money required to meet the minimum |
---|
55 | 55 | | annual salary requirement established under Subsection (e) for each |
---|
56 | 56 | | qualified constable for which the county will also use grant money |
---|
57 | 57 | | to provide that salary. |
---|
58 | 58 | | (g) The comptroller shall adopt rules necessary to |
---|
59 | 59 | | implement this section, including rules that establish: |
---|
60 | 60 | | (1) a standardized application process, including the |
---|
61 | 61 | | form to be used to apply for a grant and the manner of submitting the |
---|
62 | 62 | | form; |
---|
63 | 63 | | (2) deadlines for: |
---|
64 | 64 | | (A) applying for the grant; |
---|
65 | 65 | | (B) disbursement of grant money; and |
---|
66 | 66 | | (C) spending grant money; |
---|
67 | 67 | | (3) procedures for: |
---|
68 | 68 | | (A) monitoring the disbursement of grant money to |
---|
69 | 69 | | ensure compliance with this section, including a requirement that |
---|
70 | 70 | | the county auditor or other appropriate county officer report to |
---|
71 | 71 | | the comptroller's office on the disbursement and compliance; and |
---|
72 | 72 | | (B) the return of grant money that was not used by |
---|
73 | 73 | | a county for a purpose authorized by this section; and |
---|
74 | 74 | | (4) standards to determine if a constable is a |
---|
75 | 75 | | qualified constable. |
---|
76 | 76 | | SECTION 3. Section 130.913(g), Local Government Code, is |
---|
77 | 77 | | amended to read as follows: |
---|
78 | 78 | | (g) The comptroller shall adopt rules necessary to |
---|
79 | 79 | | implement this section, including rules that establish: |
---|
80 | 80 | | (1) a standardized application process, including the |
---|
81 | 81 | | form to be used to apply for a grant and the manner of submitting the |
---|
82 | 82 | | form; |
---|
83 | 83 | | (2) deadlines for: |
---|
84 | 84 | | (A) applying for the grant; |
---|
85 | 85 | | (B) disbursement of grant money; and |
---|
86 | 86 | | (C) spending grant money; and |
---|
87 | 87 | | (3) procedures for: |
---|
88 | 88 | | (A) monitoring the disbursement of grant money to |
---|
89 | 89 | | ensure compliance with this section, including a requirement that |
---|
90 | 90 | | the county auditor or other appropriate county officer report to |
---|
91 | 91 | | the comptroller's office on the disbursement and compliance; and |
---|
92 | 92 | | (B) the return of grant money that was not used by |
---|
93 | 93 | | a qualified prosecutor's office for a purpose authorized by this |
---|
94 | 94 | | section. |
---|
95 | 95 | | SECTION 4. Sections 130.911(e) and 130.912(d), Local |
---|
96 | 96 | | Government Code, as amended by this Act, apply only to the award of |
---|
97 | 97 | | a grant to a county under the rural sheriff's office salary |
---|
98 | 98 | | assistance grant program or rural constable's office salary |
---|
99 | 99 | | assistance grant program during a fiscal year of the county that |
---|
100 | 100 | | begins on or after the effective date of this Act. |
---|
101 | 101 | | SECTION 5. This Act takes effect September 1, 2025. |
