77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the rural sheriff's office, rural constable's office,
1010 and rural prosecutor's office salary assistance grant programs.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Sections 130.911(e) and (h), Local Government
1313 Code, are amended to read as follows:
1414 (e) A county that is awarded a grant shall use or authorize
1515 the use of the grant money only:
1616 (1) to provide a minimum annual salary of at least:
1717 (A) $75,000 for the county sheriff;
1818 (B) $45,000 for each deputy who makes motor
1919 vehicle stops in the routine performance of their duties; [and]
2020 (C) $40,000 for each jailer whose duties include
2121 the safekeeping of prisoners and the security of a jail operated by
2222 the county; and
2323 (D) $40,000 for each telecommunicator, as
2424 defined by Section 1701.001, Occupations Code, employed by the
2525 county sheriff;
2626 (2) to increase the salary of a person described by
2727 Subdivision (1);
2828 (3) to hire additional deputies or staff for the
2929 sheriff's office; or
3030 (4) to purchase vehicles, firearms, and safety
3131 equipment for the sheriff's office.
3232 (h) The comptroller shall adopt rules necessary to
3333 implement this section, including rules that establish:
3434 (1) a standardized application process, including the
3535 form to be used to apply for a grant and the manner of submitting the
3636 form;
3737 (2) deadlines for:
3838 (A) applying for the grant;
3939 (B) disbursement of grant money; and
4040 (C) spending grant money; and
4141 (3) procedures for:
4242 (A) monitoring the disbursement of grant money to
4343 ensure compliance with this section, including a requirement that
4444 the county auditor or other appropriate county officer report to
4545 the comptroller's office on the disbursement and compliance; and
4646 (B) the return of grant money that was not used by
4747 a county for a purpose authorized by this section.
4848 SECTION 2. Sections 130.912(d) and (g), Local Government
4949 Code, are amended to read as follows:
5050 (d) The comptroller shall award a grant to a qualified
5151 county that applies for the grant using money appropriated to the
5252 comptroller for that purpose. The comptroller may only award a
5353 grant to a county if the county agrees in writing to contribute at
5454 least 25 [75] percent of the money required to meet the minimum
5555 annual salary requirement established under Subsection (e) for each
5656 qualified constable for which the county will also use grant money
5757 to provide that salary.
5858 (g) The comptroller shall adopt rules necessary to
5959 implement this section, including rules that establish:
6060 (1) a standardized application process, including the
6161 form to be used to apply for a grant and the manner of submitting the
6262 form;
6363 (2) deadlines for:
6464 (A) applying for the grant;
6565 (B) disbursement of grant money; and
6666 (C) spending grant money;
6767 (3) procedures for:
6868 (A) monitoring the disbursement of grant money to
6969 ensure compliance with this section, including a requirement that
7070 the county auditor or other appropriate county officer report to
7171 the comptroller's office on the disbursement and compliance; and
7272 (B) the return of grant money that was not used by
7373 a county for a purpose authorized by this section; and
7474 (4) standards to determine if a constable is a
7575 qualified constable.
7676 SECTION 3. Section 130.913(g), Local Government Code, is
7777 amended to read as follows:
7878 (g) The comptroller shall adopt rules necessary to
7979 implement this section, including rules that establish:
8080 (1) a standardized application process, including the
8181 form to be used to apply for a grant and the manner of submitting the
8282 form;
8383 (2) deadlines for:
8484 (A) applying for the grant;
8585 (B) disbursement of grant money; and
8686 (C) spending grant money; and
8787 (3) procedures for:
8888 (A) monitoring the disbursement of grant money to
8989 ensure compliance with this section, including a requirement that
9090 the county auditor or other appropriate county officer report to
9191 the comptroller's office on the disbursement and compliance; and
9292 (B) the return of grant money that was not used by
9393 a qualified prosecutor's office for a purpose authorized by this
9494 section.
9595 SECTION 4. Sections 130.911(e) and 130.912(d), Local
9696 Government Code, as amended by this Act, apply only to the award of
9797 a grant to a county under the rural sheriff's office salary
9898 assistance grant program or rural constable's office salary
9999 assistance grant program during a fiscal year of the county that
100100 begins on or after the effective date of this Act.
101101 SECTION 5. This Act takes effect September 1, 2025.
