77 A BILL TO BE ENTITLED
88 AN ACT
99 relating to the allocation of low income housing tax credits to
1010 projects reserved for elderly persons.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 2306.6725(d), Government Code, is
1313 amended to read as follows:
1414 (d) For each scoring criterion, the department shall use a
1515 range of points to evaluate the degree to which a proposed project
1616 satisfies the criterion. The department:
1717 (1) subject to Subdivision (2), may not award[:
1818 [(1)] a number of points for a scoring criterion that
1919 is disproportionate to the degree to which a proposed project
2020 complies with that criterion; and [or]
2121 (2) may award to a proposed project reserved for
2222 elderly persons [for the general population] a number of points for
2323 a scoring criterion that is greater [different] than the number of
2424 points awarded for that criterion to a proposed project reserved
2525 for the general population even [elderly persons] if the proposed
2626 projects comply with the criterion to the same degree.
2727 SECTION 2. Sections 2306.6711(h) and (i), Government Code,
2828 are repealed.
2929 SECTION 3. The change in law made by this Act applies only
3030 to an application for low income housing tax credits that is
3131 submitted to the Texas Department of Housing and Community Affairs
3232 during an application cycle that is based on the 2026 qualified
3333 allocation plan or a subsequent plan adopted by the governing board
3434 of the department. An application that is submitted during an
3535 application cycle that is based on an earlier qualified allocation
3636 plan is governed by the law in effect on the date the application
3737 cycle began, and the former law is continued in effect for that
3838 purpose.
3939 SECTION 4. This Act takes effect September 1, 2025.
